    Check Fraud for a Payday Loan Taken Out Online
    My question involves criminal law for the state of: NJ.
    I live in NJ and some guy from Ohio called me claiming he was from litigation support services and I was going to be brought up on check fraud charges for a payday loan. He couldn't give me the exact name of the payday loan company, amount taken out or date it was put into my account. He claims the account was closed but i never closed the bank account. Can I be charged with check fraud? He never informed me of my federal rights as it pertains to debt (any and all info received will be used for that purpose) I never received any letters in the mail regarding this thank you for your help. He claims the company I owe is Payday loans LLC and they have hundreds of subsiteries. Are online payday loans legal in NJ?

    Can you? I suppose anything's possible. Probably unlikely. Unless you actually did commit check fraud.

    He has no obligation to do that but you can look them up in the FDCPA:

    Also not required.

    Did you default on the loan? If you did, the collection agent will say anything to scare you into paying.

    He never told me the name of the payday loan company that I got the money from.

    Yes I took out a few and I have 2 paid in full letters and I'm paying the others off but this guy doesn't tell me exactly who I owe

    Forget what he said. Did a bunch of money randomly show up in your bank account?? Did you receive money into your bank account that you weren't expecting and maybe decide to keep it/spend it? How did he get your number to call? What's the rest of the story OP?

    Pull your credit reports from all three bureaus. You can do that once a year for free at www.annualcreditreport.com

    See if there are any defaulted or past due loans. That'll answer your question.

    Also read the FDCPA at the link I posted earlier. There's something in there about requesting validation IN WRITING. Cite the statute when doing so.
