Reasonable Parking Accommodations for Postal Facilities, Public Areas
My question involves police conduct in the State of:MD
Federal postal police ticketed a car of a wheelchair user with proper permits, because they took up two spaces at far end of public lot, regular sized spaces are not wide enough and there were plenty of empty spaces this was due to illegal parking in provided handicaped spaces (they were not ticketed)
were under resonable accomodations would this be considered ?
Re: Reasonable Parking Accommodations for Postal Facilities, Public Areas
I'm sure any judge would throw this ticket out. Explain what you have told us, and you should be OK. It's really up to the judge and prosecutor. You have a greater chance if the officer doesn't show for court, and I'm sure they won't show. Good Luck
Re: Reasonable Parking Accommodations for Postal Facilities, Public Areas
Hopefully, you pointed out the violators to the postal police so they can testify they were there also. Good luck.

that is not the real point, I have to use this facility on a regular basis as we have a PO box there, this is new head of police and even though I have been doing this on occasion for 20 yrs he says that "postal parking regulations supersede ADA" I suspect the officer will show in this case
thanks
Re: Reasonable Parking Accommodations for Postal Facilities, Public Areas
The USPS parking regulations do not necessarily supersede the ADA. The agency is required to craft their regulations in conformance to it. In fact, the ADA specifically calls out the USPS in addition to the Federal Government in general. 29 USC 794.
It would be a defense that parking in two spaces in a distant location is a reasonable accomodation when no dedicated disabled spaces are available.
