    Paying Child Support to Somebody Who Does Not Have My Child
    My question involves civil rights in the State of: ohio

    I have been paying childsupport to a person that does not have my child! I'm paying fees to the state for a case that isn't correct. They are stealing from me. What can I do

    If this is a custody case, and the custodial parent is not presently caring for the child, you can petition the court to modify the current custody and support order accordingly. You may find that the effect of the order is that the custodial parent either has the child return home, or that you are ordered to pay the support to whomever is actually caring for the child.

    As you indicate that you are "paying fees to the state", however, it could be that the question of whether or not the child lives with the custodial parent is irrelevant -- if the child is receiving public assistance, the state will take your child support payments up to the amount that taxpayers are spending to support your child and apply it to that amount.

    The facts matter, so it would be helpful if you would tell us what is actually going on.
