    My question involves bankruptcy in the state of: California.

    Two years or so ago, we were behind on our mortgage because of a very bad refinance situation that just kept getting worse (ballooning payments, etc). The only debt we had was the mortgage and student loans - no credit cards or other loans. I began the bankruptcy process in order to save the house. During the process, we were instead offered a loan modification, which we took, and the bankruptcy never actually happened.

    Recently I went to buy a car and discovered that the bankruptcy is listed on my credit report.

    How do I get this taken off?

    First thing you need to do is check the bankruptcy case file to see if it was actually dismissed.

    If you filed the petition in the US Bankruptcy Court and just never followed through it might still show as open and that could be what's on your credit report.

    You can view the documents in your case file on:

    https://www.pacer.gov/

    The website will have instructions on how to do that.

    If the bankruptcy has been closed or dismissed then it depends on exactly what is being reported on the credit reports.

    If you haven't done so already, you can get all three at

    www.annualcreditreport.com

    If the entry says that you "filed" bankruptcy then that's a true entry and it won't come off.

    If it doesn't say closed or dismissed than you will have to get documentation from the court that it's been closed or dismissed and provide that to the credit bureaus so that the entry gets updated.

    You can try disputing the entry without the documents but chances are that your dispute will be denied and you'll have to do it again with the documents. So it's best to make sure you have them when you file your dispute.

    The best you can hope for is that the entry gets updated to the proper status. The entry doesn't disappear.
