Is It Illegal for My Apartment Complex to Put a Snow Fine Sticker on My Window
My question involves criminal law for the state of: new york
Curious if there's anything I can do in this situation. my apartment complex plows the snow after it stops snowing, not every time but occasionally. i just moved into this complex and the rules state if your car is parked where they need to plow your car will be fined. my car breaks down and I leave it for the day to go to work. It did not stop snowing until 3pm, I get home at 7pm and find my driver side window has a large orange snow fine sticker on it. I was wondering if this is illegal or if there is something I could do about it. There's nothing at all in the lease that says they will be doing this. Thanks in advance. :grumpy:

What type of sticker are we talking about? For example, are we speaking of something affixed in the manner of a post-it note, or are we speaking of a sticker that is plastered to your window with some form of contact adhesive in order to make it extremely difficult to remove?

I'm talking the large adhesive kind. The kind that when you use a razor and goo gone residue is still on the window.

I personally don't think that type of sticker is appropriate, ever. What the local police might think of the practice, though? That's an answer you can only get from them.

I couldn't find anything one way or the other but I suppose that, technically, it could be vandalism but good luck getting the police involved.
And I don't imagine you'll have much luck suing the apartment owners for the time, effort, and few bucks that it took to remove the sticker.

I suggest you consult the manager for the clause in your lease they are exercising.

Cities and municipalities use those stickers all the time. They do come off, it just takes a bit of work.

Any city that practices street cleaning or snow clearing or alternate side parking - NYC and NJ cities in particular.
To be fair, I think NYC recently changed their sticker.

I guess you win, no time to do that research except to find out NYC relented. I still maintain you'd have a hard time saying it rises to the level of vandalism.

The statute quoted above is not a vandalism statute.

Somebody else mentioned vandalism, but I'm not sure it's 'substantially inconvenient' either. Although municipalities may not use the stickers, they're common enough.
