    Child Removed and Placed in Foster Care Due to Behavioral Issues
    My question involves juvenile law in the State of: Missouri
    Recently, my minor child's Juvenile Officer petitioned the local Children's Division for the immediate removal of one of my three children from my home for what I was told 'residential treatment for his ongoing behavioral issues' CD granted his petition and removed said child, then placed child in foster care where they're doing exactly what I was doing (medication management, therapy). My questions/concerns are: "Why foster care?", "Why couldn't/didn't they keep him in the home with family focused services?", "What are my options to dispute the actions taken?"
    During the initial (72 hr) meeting, adoption was mentioned frequently, why? It isn't my actions that warranted the court to take this action, why do I have to fear losing my child? I'm confused and scared!!!

    They're likely thinking that so far you're not doing your job as a parent. How old is he, and why is he already in the system?

    Minor child is in the system due to incidents occurring at school, resulting in a juvenile officer. Child is 14 and has had well documented behavioral issues spanning years. And, I was informed that the placement is NOT due to my actions or parenting, its due to child's ongoing behaviors

    A new environment, with new influences, can alter such behavior in a positive manner avoiding the creation of a habitual criminal.

    We're still fighting CPS to get our grandson back. Yes, he lied, yes, he is oppositional; but he was performing well in school and was in a lot of extracurricular activities. No, CPS has not charged us with anything they claimed to take him.

    In foster care, they can not make him go to counseling, can not make him visit family(he's in a snit because he didn't get what he wanted), can not make him go to church, etc. Our grandson has gone from being opositional to on the verge of conduct disorder. He's about 5 days away from being truant, never missed more than 3 or 4 days with us. Currently failing 2 classes, never failed with us. Dropped out of all extracurricular activites.

    OP, is CPS saying they are going to provide 'services'? Do you have a lawyer? Are they saying YOU have to do something to get him back? Can you force more intensive mental health treatment? Do you get regular visitation & family counseling?

    The point is that the child is clearly not doing well at home with the parent/s.

    Let's try being real straight and honest. WHAT INCIDENTS AT SCHOOL? Were you afforded legal counsel at the removal hearing?

    They say they're providing counseling, medication management and that's all I'm aware of at the moment. I don't currently have a lawyer, I am however going to the courts tomorrow for a court appointed attorney (I cannot afford one otherwise).They're saying I have tasks I have to complete such as maintaining gainful employment( same job for 2yrs), weekly home sessions(1hr sessions), and there will be more as it gets underway(this only happened recently), and they say visitation and family counseling with be set up soon.

    He has been disruptive at school with disregard/disrespect for authority. There hasn't been any violent or physical altercations for almost 2yrs. I was given a paper to fill out for a court appointed attorney on Friday(I'm going to the courthouse tomorrow since its my first day off work since everything happened) and our 1st court hearing isn't until 3/10. As stated previously, child has an extensive history spanning over 6yrs.

    The child isn't doing well in any setting he's placed in, including the behavioral health hospitals that he's frequented for the last few years. I'm NOT by any means saying that he doesn't need help(I was already in the process of getting him that help, we were just waiting on an open bed at a local facility), my question is why did they take the actions that they took and what are my rights and options in the matter? I know that I'm not perfect and I've taken responsibility for that fact and was attending weekly counseling sessions with my child, I'm just stating my disagreement with the actions taken!

    I'm going to say this as gently as I can, okay? This is not being said to offend or upset you.

    But the bottom line is that State has come to the decision that being home with you might not be the right thing. It doesn't equate to bad parenting per se, but clearly what's been tried hasn't worked.

    You're pretty much on your own here, aren't you? If you'd like to mention which county you're in, I'd be happy to see what we can find in terms of help.

    Jasper County. I spoke with the JO (whom petitioned the state to remove child) today and the JO said that their main goal is to stabilize child and reintegrate child back into my home. Child does well for brief/moderate periods of time after medication change (increase/decrease, add to/discontinue, etc...), then behaviors either gradually get worse or get worse like overnight. After one hospital stay, a trained professional said that they're at a standstill and don't know what else to do with him...
