Can My Ex Keep Me from Seeing My Child and Talking to Her During the Week
I am a cross-country truck driver. My girlfriend of 6 years was having an affair. When I found out about the affair, she moved out but was still living in the same city. She has now moved in with this man and has moved 1 1/2 hours away from me. Since moving in with this man, my ex no longer lets me speak to my daughter on the telephone. In fact, she changed her telephone number. I'm usually out of town for long periods of time, and we have scheduled dates that I can have my daughter. There are times I'm able to get into town and would like to see my daughter, but now have no way to call and can only contact my ex through email. When I do email her she never replies to them, and now she is telling me that she only checks this email account 1 hour before I'm to pick up or drop off my daughter, and the few times that she does answer, she always tells me that they have plans. She told me if I want to speak with my 6 year old daughter, then I need to purchase a cell phone for her. She has also told me that my daughter is not allowed to come home with anything that I buy for her, and if I send it with her, it will never make it into the house, it will be thrown in the trash can.
Can she get away with all this? Being that I'm out of state a lot, I haven't been able to see an attorney.

We need to know which state you're all in.
But generally (in the US), Mom is the only legal parent until Dad files to establish paternity. If you haven't done that, Mom rules and you're not legally entitled to any visitation or custody at all.

Sorry, we are in California.

Has paternity been established? If yes, is there a current order?
