Can You Accuse Somebody of Custodial Interference Without a Custody Order
My question involves a child custody case from the State of: KY My ex girlfriend ran off and hid out from me for 6 wks. CPS is involved. She got arrested last weekend for a felony child support warrant w/her older son. When she got arrested the baby was left with her mom. They were staying in a hotel since they dont have any place to live...After 2 wks we finally found them last night...The grandmother had taken him out of county w/out reporting to CPS since before the mom got arrested. When finally found them I tried to get her for custodial interference but because she returned when to me w/CPS & police there they said that until I get court ordered custoday & since he was returned I couldnt. I never thought about kidnapping charges...Any suggestions? Well other than dont date crazy chicks lol

If there is no custody case, then there is no custodial interference. Do you have a custody case with your ex girlfriend for the child you have together?

Why is Mom running? If you don't have custody, what are you complaining about to CPS? Are you even the legal father? Why is Grandma not allowed to take the child? The child is NOT in CPS care, correct?
