    Emancipation Retroactive Pay
    My question involves child support in the State of: Indiana

    My child turned 19 yrs old 2 years ago and her father isn't filing emancipation paperwork until now and has continued to pay full child support. Can the father get retroactive child support back from the mother for 2 years since he didn't file the paperwork until this year?

    I believe Indiana is one of those states where a child can receive support until 21 if they are in college. Voluntary over payments are not normally ordered to be repaid.

    The law changed in Indiana a year or two back to make it 19 instead of 21. However, that didn't automatically make prior orders invalid. Therefore I agree that if dad waited until now to file to emancipate the child he would not be entitled to that retroactively.
