Team Parent Sent Nude Pictures of Me to Entire Softball Team of 12 -13 Year Girls

My question involves criminal law for the state of: California


Team parent sent nude pictures of me to entire softball team of 12 and 13 yr old girls and parents while at tournament in Arizona he received from my ex.

On Nov.7, 2014, I had just gotten home around 11:10 pm,when I started receiving texts messages from some of the parents on my 13 yr old daughter's softball team. The picture attached was of me , naked, nothing sexual but still naked. My ex-wife is the Only one that stole that picture from computer trash, as it wasn't flattering. She sent it to the two parents who continued to send it to the entire team, including 12 and 13 yr girls, the parents,and coaches and league owner. I immediately asked from what IP Address and number did the text came from, which all pointed back to Arizona and my ex's phone where the picture came from.

Now I am being threatened by people on the team that it is going to ruin my name, reputation and sending it throughout the internet to my business. Can I do anything to stop this and am concerned that the girls on the team including my 13 yr old are now involved. The police could see right away I could not possibly send it thru the IP address and traced anonymous phone number that pointed to the suspects I knew were behind all this. ATT has also traced the numbers and positively identified those involved. I have a police report ,as well. And a witness who saw picture that was sent to me.

 Any help or suggestions would be great help. My ex has been already been arrested 3 times for DV and has another pending. We are scheduled for a child custody hearing coming upon a couple weeks and I suspect she is trying to paint me in a bad light.

I might add that I awaiting a heart /liver transplant at Cedar-Sinai and this last offense is a continuation of cyber harassment isn't helping me health wise. The team and all adults are thinking this just a big joke on me. I find it humiliating and beyond belief. Can anybody help me?

You want to take this as a personal slam. You should not be ashamed or humiliated of your naked body male or female. In regard to those who disseminated your picture to the teams minors, the police will deal with anything they deem to have been a violation of the law. This is one simply one of those .... remember the time when things. Why should anyone on the team be threatening you? That appears to be blackmail and reported to the police. Trust me, as you get older, more and more strangers are going to be seeing your junk. If you have heart and liver problems, it is going to happen soon. Get some good press. Call the local paper and see if a staff writer wants to write a story, including the name of your business about how your ex started the beginning of pictures of your junk around the team. That will stop any other versions from being whispered in break rooms.

Disagreeable is correct that, with this being in the hands of the police, they will review the matter for possible criminal charges. It's not clear to me why the two adults who received the photo chose to re-distribute the picture, especially to minors. That was inappropriate, and also may serve to insulate your ex- from serious consequences. Do you have any idea why they made such an inappropriate decision?

I feel SO sorry for your child. This child has one parent that is (allegedly) sending nude pictures of their father. The other parent has ADMITTED to vandalising the mother's car.

She can't win. I hope she gets away from both of you soon.

I appreciate your reply. My opinion about you changed and I apologize for the reply under' civil rights' case. My ex keeps doing some very low and painful acts like this. Anyway, thank you.

Hello, thank you for your reply. The other two suspects are friends of my ex. I have had problems with both in the past . I have given the police all records verifying their identity. The pictures sent to me were sent as ' Unknown' . After hiring a company to track these txts, they show my ex and both suspects phone numbers and time line data matches everything . Plus, when police contacted her, she replied I was making it all up, and the officer wrote it as such, then two days later , one suspect called the Sheriff's and admitted his part and described the picture in detail. The police have not filed anything because the picture disappeared off my phone within hours but the txt all indicate it was a nude picture, but a witness on my end saw the picture right when it came thru , but police have never contacted him though they knew this witness exists. They say I need that picture to start a criminal case. I am hiring a cyber forensics expert to hopefully retrieve that picture from my phone.

Funny, you should be the one to judge one without all the facts. Your hands certainly not clean so until they are, you should be professional and refrain from judging others without all facts

I wonder how truthful the "facts" are. I know if somebody sent my 12-13 yo child nude pictures I would be on the phone with the police in a flash yet here, none of the parents of the children have become involved. Now we have the picture somehow disappeared from the OP's phone as well. Hmmmmm. How does that happen?

I don't see a crime against you here so there would be nothing for you to start. It was the people that sent the nude picture to children that have committed crimes and the police can obtain the image if necessary. Why none of all of these people that were sent the image called the police or have the image stored so they can report it is beyond believable to me.

When life gives us lemons, make lemonade. Let the police enforce the law.

The suspect that came forward stated to the police that the picture was never sent to the girls, but my ex and friends were playing a joke and trying to scare me. I felt the same way, Why aren't any other parents calling. It was passed amongst about eight people in their little group. It is still a crime.

really? What crime would that be?

Lesson learned: Don't pose for a nudie/share a nudie with anyone...no matter how much you trust that person. It can come bite you in the butt later. I know you're experiencing pain and anger right now, but unless you are a Reality Star...not many people will see it. It seems like it now probably....

Next: Ok, I have dealt with being royally screwed over by "friends". Yes, I would love to sue their butts in Civil Court. But...Can I win? Yes. Can I collect? Likely not. What Will I spend to win my case and collect my damages? More than I will ever see. Ok, so put those questions to your case.....ask yourself those questions.

Actually, if I were to do anything, it would be to take steps with the school to have those parents banned from future events as they are a poor influence on the children.
