Fanbox.com is Preventing Me from Cashing Out My Earnings
My question involves a consumer law issue in the State of: San diego
Hi
I am on a website called fanbox.com and i have made around nearly $19,000 to $20,000 on the site but i am having alot of problems with the way they're running the site, they're doing unethical actions and holding members money hostage by never letting them cashout there money, they have something called "boosting" and they're forcing there members to keep there boost on for atleast 30 days or you can not have your money after 90 days, now the boosts should be only around $1 to $67 a day, as you boost your ILP = I'll pay later" loan goes higher and higher, and you have to pay a fee on this loan of 1.57% ..now that would be ok if they were not committing fraud against me and sending me ridiculous boosts of $899 to $460 a day, which is crazy, but they're doing it so that at the end of this month i have nothing! to cashout at all. its fraudulent behavior and i am not about to let them get away with it, i would not mind paying the fee's on my boosts if it was being done in a non scammish and legitimate manner
you can only pay these fee's on there loans mainly with your paypal or bank account every month
(which seems highly suspicious whether that is even legal or not)
Now the problem i am having with fanbox.com is i am about to be able to cashout around $7,000 at the start of February but fanbox.com is boosting my money by $899 daily and $460 today they boosted my money, which is forcing my 90 days cashout money to go down lower and lower until there is nothing left for me to cashout into my paypal (which is where the scam they're running comes in to it) the boosts should only be between $1 and $67 a day, but they are doing these kind of unethical actions that has angered everyone on the site,
they're holding members money hostage in essence and they are not even trying to hide there fraudulent behavior because they believe that they're invincable and nobody can touch them
i have saved all my evidence to my computer, from success coaches that have said things to me on my skype of their bad behavior going on within the site, to all my bank balances for the past few years, they also force the success coaches on the site to go out and thread bomb all the blogs and forums out there that rubbish and give bad reviews to fanbox, the site is such a scam it's crazy how the BBB has not shut them down yet, but the site is not accredited nor does it have a very good BBB rating
when i confronted the fanbox support team by email today i got into an argument with them, i let them know i am tried of being scammed, they're sabotaging my account so i can never cashout ...right after our email conversation was over they spitefully added 5 x $900 boosts to my account to hurt me and to let me know that they can do anything that they want to me and there is nothing i can do about it
i have a snap shots of this sabotage that they did to me just today with the 5 x $900 boosts saved to my computer, i have snap shots of everything they have done to me over the years
I was given advice to contact the san diego attorney general and i am writing a letter to her as we speak, and i am just about to send an email to the US online fraud police in the states.
Also the fanbox president on the site even threatened members if they talk or complain then there accounts will be closed which means they can keep our money, another success coach on the site informed me on skype that they love! finding members that break there T/O policy, even a little bit so that they can quickly close there accounts and keep there money, they're scamming people, please help me stop them, i have everything saved to my computer, i even save my fanbox bank balance to my computer everyday just incase i get scammed, like i am being now, it proves there unethical behavior ..I saved his whole disgraceful blog to my computer as well
They're fraudulently trying to stop me cashing out my money at the end of this month with these unusually high fraudulent boosts of $899 and $460 a day and i do not even have a pu badge ..i can explain more what a "pu badge" is if you end up helping me, as i said boosts should only be between $1 and $70 a day, just like it is for everyone on the site
they're doing it so that they can charge more and more in monthly fee's so that they can dip their greedy and sticky hands as far as they can into mine and everyone elses paypal and bank accounts and stop me from cashing out any of my money every month
Someone help me please
if any lawyer can help me and give me a no win no fee deal, and i mean a real and legitimate no win no fee deal then please send an email to me.
I am more than happy to pay a percentage of the money that they owe me from the $19,000 if i win and a percentage for any damages i might receive for the total hell! fanbox.com has put me through over the past 3 years
If anybody on this forum knows of any place that might also be able to help me please can you help me out and tell them about me or give me there information of any lawyer or site
Re: Fanbox.com is Scamming Me
The BBB has absolutely no regulatory authority.
I suggest you look at every single letter of any small print, as I suspect the terms of service will cover them as much as possible legally speaking.

Thanks for your reply Dogma :)
but surely websites can not just do anything that they like to just because they say that they can in the their own fine print?
i was thinking about the BBB but as you suggest they have no real teeth
but i am not giving up, i really dislike fraudulent people or websites
Re: Fanbox.com is Scamming Me
They are not scamming you. It appears they are a scam. There is a difference. The difference is you agreed to their TOS.
Quote:
XIV. FanBox Earnings
A. Eligibility to Receive Earnings
FanBox may award you virtual currency in the form of earnings ("Earnings") in connection with your use of the Services. Your investment of content, earnings, time, payments, including the purchase of Advertisements on the FanBox Network and relationships, may never materialize or result in any direct or implied benefit or asset for you. Any Earnings, payments, or in-kind benefits will be made solely in the discretion of FanBox, and you waive any rights to receive revenues, profits, Earnings, and any value of any kind other than any of the foregoing actually paid you by FanBox.
Inactive Accounts are not eligible to receive Earnings. FanBox may award Earnings based on numerous factors, including but not limited to (i) the volume of traffic your blogs or advertisements receive, (ii) the source of that traffic, (iii) the activity engaged in by visitors to your blogs, User Generated Content, or advertisements, (iv) the nature and quality of your blog, User Generated Content, or advertisement, (v) the amount of Earnings then available for distribution from the Active Blogger Pool (as defined below); and (vi) other criteria which FanBox may or may not disclose to you or to other FanBox users in its sole discretion. FanBox is not obligated to disclose the basis for its award of Earnings to you or any other user or the manner in which it calculated such award, but in no circumstance will an award of Earnings be based, in whole or in part, on any element of chance. You understand that the presence of any one of these factors does not in and of itself guarantee a generation of Earnings.

Re: Fanbox.com is Scamming Me
They're scamming me now!, they were not scamming me before because they have recently changed all there rules which has NOW! made the site a scam
so when i agreed to there TOS as you suggest the site was running a legit online business (btw i never joined the site, they got my email address from somewhere and decided to sign me up without me knowing) but thats a whole different discussion
so in summery since they made it you can no longer cashout your money and they decided that they will just keep our money indefinitely which they implemented and put into place around 6 month ago then i never agreed to that at all, they have around $19,000 of my money, what am i suppose to do, i can not just close my account, i am stuck
but your argument that i agreed to it is not correct hench why i certainly have a case
Re: Fanbox.com is Scamming Me
You know those Terms you agreed to when you first signed up? You also agreed to any changes they make. Since you do have the legal right and ability to close your account, that's a valid option.
Read this: http://www.fanbox.com/socnet/Tos.html - I know you feel it's "wrong", but it's not illegal.
Re: Fanbox.com is Scamming Me
i never signed up, i think that's the loop hole
they grabbed my email from somewhere and my name and signed me up, i saw the email and checked the site out since they already opened an account for me without me knowing
i think i might have more of a case than you might think
so that means websites can do absolutely anything! they want to anyone no matter what they do and nobody can do anything about it, so ebay can steal your money out of your paypal and there is no recourse for anyone
well if thats the case, so i am going to start a website, make up my own TOS that will state that i can except your money, not give you anything in return and never refund you a cent
Re: Fanbox.com is Scamming Me
Ebay didn't steal anything.
You chose to act after receiving an email. And believe me, your email address has been sold over and over again - and there's nothing illegal about that, either.
When you chose to deal with what are essentially get rich quick scams, you tend to get shafted. If something sounds too good to be true....it generally is.
I actually did find this on more than one complaints page:
Quote:
WARNING: Please use FanBox for entertainment purposes only. In particular, your use of FanBox may never materialize or result in any direct or implied benefit. Any content, Earnings, time, payments, and relationships associated with your use of FanBox may be subject to modification or termination.
To put it bluntly, they're like every other scam artist. They'll bombard you, your Mom, your boss... because they know that someone somewhere won't be able to resist the dollar signs sparkling before them.
Oy! Come back here! I just spent 15 minutes (and they were REAL minutes!) trying to give you a hint!
Re: Fanbox.com is Preventing Me from Cashing Out My Earnings
As I told you elsewhere, contact IC3. They have done this same thing under another name and were forced to change it. Otherwise, try to find a sympathetic member of Anonymous.

Re: Fanbox.com is Scamming Me
just because they made up a very selfserving TOS set of policy's that doesn't mean all bets are off, surely there has to be some accountability somewhere, sometime
i never joined the site technically, loop holes-a-plenty ...yeah! ok, i am grasping at straws ..so sue me (Pardon the pun) :p
thank you disagreeable, you have been most helpful
bless! :)
