Collecting State Disability Insurance After Unemployment in California
My question involves unemployment benefits for the state of: California
    Hi,
I was laid off from work in September 2013. I received UI benefits until May 2014. Currently I'm pregnant and filed SDI claim in December. I have sufficient wages for SDI claim in my base period and actively looking for work since my lay off. Still I'm denied SDI benefits saying 'i have withdrawn from labor market before disability'. I haven't done anything like that. I've been applying for jobs regularly. But I think my caljobs.gov profile is disabled without my notice. But I hadn't had much luck with caljobs so stopped applying thru them. Should that matter? I have many emails proving my job applications, isn't that sufficient? I'm going file an appeal but wondering if it's worth the effort? Please advise. Thanks!!

You were not working and your UI had run out. Sounds like you were out of the labor market to me. CA disability is not so every pregnant woman can get a free income for the duration of her pregnancy. That is welfare and is needs based.

    Agree.

    You're not disabled. You're pregnant.

You're not entitled to disability benefits.

    Try the welfare office.

Or hit up the guy who got you pregnant.

You guys clearly are unaware that CA is one of five states where disability benefits are mandated by state law, and do cover pregnancy. If the employer does not provide disability benefits, the state does. Pregnancy is absolutely covered under these state plans.

However, I don't disagree that the employee is *probably* not eligible since she has not worked for over a year. In this case, it doesn't matter that she's been looking for work - what matters is whether she has worked.

I'm too far along my pregnancy ( 1week for due date) and had to turn down a job interview for which i had to travel right away. Even i though i did not find any job in last year, my base period has sufficient wages which made me eligible. edd has sent me computational notice also.
