What Are My Responsibilites As a Custodial Parent when Moving Out of State
My question involves a child custody case from the State of: Texas
I am moving out of state tomorrow, and my son's father is giving me a very hard time even though he has known months ahead. I am just wondering because I am moving out of state from Texas to North Carolina what are my responsibilities as far as my child and his father? Financially I can not afford to fly or drive 17 hours every weekend, which was made very clear to the father. It is also no in my sons best interest to do that drive every other weekend nor fly due to school. I am moving with my husband, he is attending Duke and I have received a very good job there. I emailed the Attorney Generals office about this situation and they basically said they have no ruling over where I move. That is a decision I can make, but it just didn't seem like they were too informative so I am just asking for some clarification. We will be moving back to Texas in 2017-2018.

I would expect Dad to file in court IMMEDIATELY to have the child returned pending a change in custody. Expect the court to tell you that you're going to be paying for transportation, and expect the court to raise an eyebrow when you're moving because of your boyfriend.
You may find that you have a choice - either stay put, or hand over custody to Dad.

why would you wait to ask this the DAY before you move out of state? If you are the one relocating the child, then you may (and most likely will) be the one paying for dad to fly out and visit son, or visa versa. Do you have custody orders in place? Is so, did you even bring this up to the court to notify them of your intention to move out of the county the custody case is in?

Psst....
Its Texas...you know, that state where its standard verbiage in many counties that the order says that the custodial parent has the right to decide where the child will be domiciled. I cannot guarantee that her order contains that language, but there is at least a 50/50 chance that it does.
