    My Roommate Won't Sign the Form to Release Herself As Our Roommate
    My question involves landlord-tenant law in the State of: California.
    I really could use some help, my boyfriend and I have been having trouble with our roommate since moving in. It got to the point where she refused to pay her rent and utilities, and we wanted her to leave, and found out from the rental office that she had already started the paperwork on a release form, but that she had changed her mind and had disposed of it. We got a new release form to release her from the lease, and she told us she'd sign. Today, she came to move her things out. All throughout the day, we politely tried to get her to sign it, but she kept saying she'd do it after she was done. At the end, she told us that she wasn't going to be signing it until she talked to the apartment management (meaning she may not sign it at all still) and just left, which I kind of expected at this point. Since the rental office was closed, there was nothing we could do about it and we tried to find an emergency number, but no luck. We were told that if she signed the release form, we could downsize to better afford our rent. We think she's trying to get back some of her deposit which is why she's refusing to sign the form (by signing it, it says she is forfeiting her deposit). What could the rental office do to help us should she refuse to sign the form when she goes in to talk to them? Would they give her back any deposit if she still didn't sign despite her breaking the lease by moving out without 30 days' notice? Is there anything the actual owner can do? I'm very worried, because at this point, we can't afford to keep this apartment and were making preparations to move already. Please help. :grumpy:

    How about you and your boyfriend come up with her share of the deposit, and offer it to her as an incentive for her to sign the form? If there's no damage to the unit, you'll get the money back when you vacate.

    The rental office can give her the form, but they can do nothing to make her sign it.
