THAT is why you go to court and get an enforceable visitation order- which is what most of the posters advised you to do. Your inaction put you into this mess. Don't blame the volunteers here for your inattention and don't say you didn't know what to do. One hour with an attorney or some more research and you would have known exactly what to do. So please...

The probable remedy here is that either you pursue becoming the custodial parent or you have child support redirected to the care giver. To do either you are probably going to need to hire an attorney to help you with that battle. The OAG isn't likely to help you out here. If the OAG calls the care giver and the care giver denies having your son and the mother tells the OAG investigator that she does have your son then that's probably as far as they are going to go. The child support division's primary interest is making sure support is being paid appropriately. They are far less concerned about other family issues and they lack the resources to focus on other issues.

Does this town have even ONE attorney? How about a courthouse in the county? Legal aid?

yes there is a County Court and all here (200.000+ population) and yes all i want to do is redirect the support so he will understand why i Cant always get him the things that he wants. I do believe that now the lady will admit to the court she has him, but listen his biological Mother gets Housing assist on him and the lady gets foodstamps so is this a matter outside child support that can be taking they are spliting state benefits on him. Cant he mention to the court that he has never lived with his mother?

You're complaining to the wrong people.
You've had PLENTY time to get a court order for visitation. That you didn't, is not our fault,
It's also perfectly legal for Aunt to decide she doesn't want Mom to pay...but you'll be paying regardless.
