    Felony Charges for Failure to Return a Rented Truck
    My question involves criminal law for the state of: Pennsylvania
    My wife just found out that she has a warrant for her arrest and charged with F3 theft by unlawful taking movable prop and F3 receiving stolen property. this all stems from returning a Budget truck rental late. She Has no past criminal record and this is york county pa. What do we do?

    Work with Budget to see if they will request the prosecutor drop the charges and pray. I would say receiving stolen property is a stretch, since she already had possession. She needs a lawyer.

    A lot depends on OP's definition of "late".

    She may have been charged with receiving stolen property if she was not the one who rented the truck.

    I've rented trucks from Bucget and Uhaul. Also in PA. Have been "late" and never had this happen. OP, what does "late" mean? We are missing details. As is, simply being a few hours or even a day late will not result in Budget calling the cops. HOW late was this? Need more details. Additionally, you (or your wife) knew when the truck was due back, correct? So you (or someone) did call to inform them correct?

    Late just gets more charges tacked on. Not returning the truck until they have to come looking for you is theft by conversion.

    This same poster asked the question in another forum and we asked for an explanation of what happened and the poster never returned.

    The basic advice: If you're facing felony charges, no matter WHAT the circumstance, you need an attorney.

    I actually have some experience with the York County PA police and DA's office. I was just over the line in Baltimore County.
    There has to me more to this: i.e., they came looking for the truck rather than it being "returned late."

    Also, at the point that they got it back in the original condition it was in, they would likely have little to no interest in pursuing criminal charges.

    There's a lot more to this story.
