Re: How to Get Emancipated
You have a job that will allow you to pay 100% of your own support while still going to school? You have a budget to show the judge that will describe your income, your expenses, and how the two coincide? Your home has been declared unsafe by the authorities? You're old enough and mature enough to live on your own, but not to find the process for yourself?
Re: How to Get Emancipated
So you are earning about $2000 per month and maintaining good grades in school? Do you have your health insurance costs lined up as well as the rent to live alone, along with utilities, food, miscellaneous expenses and transportation, while maintaining at least a B average in high school? Do you have 6 months wages in savings if you were to lose your $2000 per month job?

To qualify, the child must be at least 16 years of age and one of the following:
The parents agree to let the child live on his or her own;
The parents agree to let the child live out of the family home for at least 3 months, living on his or her own; or
The child can give reasons why the home of the parents or guardians is not a healthy or safe environment.
For a court to grant an emancipation order, the child must also show he or she is self-sufficient. This includes:
Proof of employment (state, federal, or local government assistance does not count as employment);
Showing the child can handle his/her own personal matters; and
Showing the child is able and committed to going to school, a training program or employment.
Re: How to Get Emancipated
Yes, I have had a job for over a year and the court has already told me I can live with my older brother. And there is an ongoing DHS investigation because of the conditions but it involves my younger brother he has already been removed because of the conditions. But I was not the subject of this report so I was told by DHS to go about it another way. I was told to get a lawyer but I just was inquirying on other advice.

The court has already told you? And when did they do that?
Re: How to Get Emancipated
In my situation I do not need $2000 a month. But I do make about $550 and while it says no state income my mother passed away and I get a $600 check each month from that. I'm a A average student I have enrolled for nursing school next fall. I have a car also. I am not trying to get Emanciapted to live on my own it is to live with another relative and this is the only way I was told by my worker I could.
Re: How to Get Emancipated
Eh, I'll come right out with it.
No, the court didn't say that. I guarantee it. Why? Well, no judge will give you any sort of answer before there's actually a case in front of them....
In other words, you either completely misunderstood, or you're not being entirely truthful.
Re: How to Get Emancipated
A month ago I have been living here for a month but my dad changed his mind and challenged it. Which is why I have to go through this process now. DHS has said that i can legally stay here, but now my father revoked it.

You're not understanding. That's not how emancipation works. Your "worker doesn't appear to understand the law, either.
If you want to live elsewhere you have two options.
You can either get your parents to consent, or CPS removes you.
Re: How to Get Emancipated

Bekah, come on. DHS doesn't make that decision...without court action.

STOP.
The court employees CANNOT tell you that. THEY ARE LEGALLY PROHIBITED FROM DOING THAT.
Re: How to Get Emancipated
I'm not saying they gave my legal permission. They said that if I get Emanciapted I would be aloud to live with my older brother. And they had court action saying my brother was to be removed permently and my dad was in jail for a couple days so I was to stay with my brother during and after because of the ongoing child abuse. He filed a missing person on me, fully aware of where I was, and the cops had no choice because nothing has been finalized yet than to return me to him. My brother is younger and therefore his has already been finalized
Re: How to Get Emancipated
Do you understand that living with your brother is NOT the same thing as being emancipated?
Re: How to Get Emancipated
Yes I do! But in order to do so I have to be Emanciapted. My dad won't give permission and im not willing to wait until he hits me again in order to get removed by CPS
Re: How to Get Emancipated
Re: How to Get Emancipated
My DHS worker and a P.O. Officer involved in our case

I understand you guys have questions but no one has really answered my question. The circumstances regarding my case shouldnt matter.
Re: How to Get Emancipated
If you're mature enough for legal emancipation, you're mature enough to find the forms without help.
Re: How to Get Emancipated
I would think you'd be mature enough not to be rude because I asked a question about a legal thing, on a site designed for that.
Re: How to Get Emancipated
Here's what you're not seeing.
The court will not emancipate you so you can go and live with your brother. You have to show the court a history of supporting yourself before they'll even consider your petition.
That's pretty much all there is to it.
You're welcome

This is true. The problem is, you have no chance of being emancipated.

Fail. The matter would have to DIRECTLY INVOLVE YOU.
Am I speaking a different language?
Re: How to Get Emancipated
$1150 is not enough without a guarantee you can afford health insurance, transportation, being fired, etc. You have also stated the home life reason has already been corrected.
Re: How to Get Emancipated
Seeing as I have been living away from my father for 2 months yes. And I have medical coverage. And the home life has not been corrected. There has been multiple DHS cases against him. He is abusive both physically and emotionally. This incident that just happened involved my brother maybe but other have involved me. You guys can try to talk me out of it all you want but i am going to listsen to the adults I know and trust. I would do anything to get out of that environment

I don't see where you indicate your age. But, beyond that, what the adults you know and trust have to say means diddly hoo-hoo unless a judge orders your emancipation. Until that day you are subject to your parents' rules.

If you are only a few months from 18 then you will likely BE 18 before you can get a judge to decide ont he matter especially if that parent opposes your emancipation.
