    MIP and Misrepresentation of ID to Get Into a Bar
    My question involves criminal records for the state of: Louisiana

    I am 17 years old and i will explain what happened last night

    My friends and I went out to a bar last night and when i was inside the bouncer asked me for my ID and my "Backup" the last names did not match so he kicked me out. I stood out front for awhile with the guy telling me to leave, i tried to bribe him to let me back in and he took it but didn't let me in. I was really drunk so i was pissed and wouldn't leave then a cop came over and made me call my mom to pick me up. Since I was really drunk I didn't realize i had like a pint of Captain Morgan in my back pocket, I wasn't even drinking it, it was just there from when i was pre-gaming. So the cop gave me a citation for minor in possession and misrepresentation of identification to enter a licensed establishment.

    My question is will this get erased when I turn 18, will I need to report this to colleges, and will I still be able to get into college with this on my record. Also will this severally hurt me in the long run with getting a job? Any help is great thanks.

    As a seventeen-year-old, your state will prosecute you as an adult with any conviction being recorded on your adult criminal record. You should consult a criminal defense lawyer about your case, and any possible way that you might avoid a conviction.

    OP - another line of thought is that you could simply be honest with any potential employer and explain to them that you were drinking underage. Not to justify anything, but let's be real. Kids drink underage. You did, I did, 75% of the people on this forum did. Kids will continue to drink underage far into the foreseeable future. Any employer that you want to be working for will understand that you, as a kid, made a bad decision to fit in with your friends.

    As others have said, this will be publicly available for others to see. Given how easy (and cheap) it is for anyone with an internet connection to run a background check, you should expect potential employers to check yours. And that is why you take the high road, fess up to your mistake, and explain to the interviewer what you learned from that mistake and how it has made you a better, more responsible contributing member of society.

    If the bouncer took a bribe but still did not let the OP into the bar, then didn't the bouncer commit theft? If the OP is going to be prosecuted, he might as well take the bouncer down with him. The OP should file a complaint against the bouncer for theft of money.

    That's like a guy trying to buy weed taking the dealer to court when he runs off with his money, no?

    As stated, quite a bit of the population does underage drinking......

    Now....to explain to a potential employer....because the underage drinking is one issue....

    But you have another BIG issue....the fake ID and that charge. That is gonna tell Joe Employer that this was not an isolated incident.....

    If I were you....get a lawyer.
    - Tell your lawyer about the bouncer. But don't expect anything to come out of that. It is your drunk ass against Mr Bouncer. And if your case goes in front of a judge or jury....you don't wanna piss off Mr Bouncer who will testify that you were drunk off your ass, in possession of fake ID, and *tried* to bribe him.
    - Tell your lawyer where you got the fake ID. Might be a nice way of making a plea bargain?
    - Get your ass into AA.

    I know in MD if its a first time offence you can get whats called a PBJ probation before judgment so it wont end up on your record, I got one when I was a kid and got caught with pot. it was a long time ago so I don't recall all the details someone on here might be able to explain it better.

    as for your bouncer issue, he will never say you gave it to him, so your out of luck on that

    This dude has 2 charges....so that may have an effect on what kind of deal the prosecutor will offer, or if a First Time Offenders program will even be allowed.

    Search the bouncer's money. Perhaps the OP's fingerprints are on some of the bills.

    I know of a legal case where a lawyer bribed a witness to lie on the witness stand. The witness kept the money in a safe place. The witness then turned the money over to the proper authorities. The lawyer's fingerprints were all over the money, and that lawyer was disbarred.

    The witness in question was former Chicago newsman Russ Ewing, who came to our high school and told us about this experience.

    A lawyer bribing a witness (a witness who is a reporter - a high-profile person of public interest, no less) to commit perjury and a bouncer accepting money from a drunk kid are two entirely different scenarios. Being a bouncer is not a position for which bribery charges could be brought and has no established professional ethical standards, nor is it regulated by any professional organization, that could lead to the equivalent of disbarment. Trust me, the police are not going to expend the resources necessary to obtain a warrant for all currency in the possession of the bouncer, and then forensically examine all that currency for OP's fingerprints, for a misdemeanor MIP case. The only possible charge against the bouncer would be petty theft - and finding money with the OP's fingerprints on it is not nearly enough to establish probable cause for even that minor charge.
