Hit by a Truck That Crossed a Double Yellow Line
My question involves a traffic ticket from the state of:Nevada
I was driving in a two lane road with double yellow lines following a truck pulling trailer. The truck merged over double yellow into left lane with no blinker. I thought something was wrong until I noticed he continued driving for some distance. So I continued in my lane and as I began to pass he made a right turn into my car.Never looking to see if any car was next to him. The right front corner bumper of his truck hit behind left rear door down left qtr panel to bumper. I'm sure he did not use blinker because when he had merged into left lane earlier he would have turn right blinker on immediately to alert me he was turning right. He was not paying attention and was unaware of vehicles around him.

I took photo's of both cars and the road where accident occurred. No one was hurt so we did not contact police. We exchanged info and left. The problem now is his insurance is denying my claim stating that his statement says he used his turn signals. Doesn't matter if there were any other traffic violations and that no one from his insurance came out to investigate my claim. They are only going by word of mouth and because he is there insured they believe him and are closing my claim.

Has anyone ever heard of this before and what can I do to have this taken care of. I am not to blame. Is there any laws that protect me?

You pay your insurance company a lot of money each year for specifically these instances. Let them handle the claim. They don't want to pay it either so they will do whatever they can to collect from the other driver's insurance. Blinker or not, there was an accident, with (I'm assuming) damages. Just because he may have used a blinker doesn't excuse his insurance company from paying you if he was at fault. Either way, let your insurance company and their lawyers handle this for you.

By "truck" do you mean a semi? Given the turning radius of a semi, that would be consistent with his pulling toward the left before making a right turn.

One lane in each direction, then?

You were passing him on the right?

If you carry collision coverage for your own vehicle, make a claim with your own insurance and let them sort it out. Otherwise you can resort to small claims court, assuming the damages can be recovered within the court's jurisdiction, but his insurance company will help him and you'll still be dealing with 'your word against his'.

    Sure.

    Happens every day.

What you have to understand is that the other driver's insurance company is not your insurance company and owes you nothing unless and until a court of law finds the other driver responsible and says how much.

In this case his insurance company believes it has good reason to deny your claim.

Two options. 1 - Sue in small claims court if your damage is within the $7500 limit. 2 - Use your collision coverage if you have collision coverage.

And he says he is not to blame.

    Yes.

    Negligence law. Coogle it.

You prove, in court, that he was negligent and you weren't.
