Can My Roommate Deny Me Keys and Use of the Property
My question involves landlord-tenant law in the State of: Montana
In early November, my fiancee amd I moved into a 3br home which already had two people living in it. A woman living on disability and her teenage daughter. I live in a college town, so this living situation isn't that uncommon.
From the start, she refused to allow us to have a key to the deadbolt which is locked at night. My fiancee works from 1am-6am. She has to let him in, and she doesn't always bother to hurry. This morning, for instance, he waited 15 minutes outside in the 20 degree weather.
Complicating the problem, we were recently in an accident and our truck was totaled. We are currently looking for another. My fiancee filled her truck with gas so we could use it. Yesterday she refused to let him pick me up after school and made a scene for over an hour. The only thing we have used the truck for is his work and my courses. She has another car which we also put gas in.
This morning, after letting him in, she told us that she almost didn't want to let us use the kitchen because of a dish I washed which was put away wet. She also told him that it was her home and he should respect it more.

Never damaged anything on the property. We are renting the master bedroom for $700 a month, and we aren't entirely sure the money we pay her is getting used for rent because she says she's behind on rent and the owner of the home is looking for a reason to get rid of her and resell the house
Even with all of this, she continues to ask us for favors, money, and is even suggesting we move to a new place together . We don't have a lot of friends here, and none with the ability to take us both in. If this continues we won't have a vehicle and we will be out gas money. If the landlord throws her out, we don't have money to find a place immediately,, due to the accident.
She is very pushy, entering our room without permission and even seeming to scold me for the way I play with my kitten. It's gotten a little strange and I'm really ready to leave, utbutdon't have the money right now.
Is she allowed to threaten us with the use of 'her' kitchen? Can she not provide us with keys to the door? If she does refuse us access to the kitchen, does that mean we don't have to pay the full rent because she's breang our verbal agreement?

You say that this woman is your "roommate". Are you in fact subletting the room from her? If you're subletting, the issue may be that she has no additional key to give you. Does her lease permit subletting the room? If so, does it require the landlord's approval? Did the landlord approve?
If you're not subletting, what did your landlord say when you asked for a key to the deadbolt?

You have absolutely no right to use her truck if she says "no", even if you filled up the tank after the last time she let you borrow it.

If you do not like your landlord, move. It appears you are a month to month tenant. Follow state laws for notice.

I am aware that I have no legal right to use her truck. I merely added it as an indicator to her record of keeping her word.
I am currently sub-letting the room, with the landlords approval. I am currently working on getting added to the lease. The problem is the landlord has basically told me that he has no key and he doesn't want to get involved until I am on the lease. Even then he refused to give me a straight anseer about his willingness to make me a key.
He is basically treating this as a problem between roommates. She has two keys, because she has lent me one, but refuses to let me keep it permanently. I am not in possession of a key currently.She only allows me to use one when she is gone overnight.

She lends you the spare? Is there a reason why you haven't gone to a hardware store with it and had a copy made yourself? This is not a complicated or expensive thing to do.
