Grandchild Murdered in an Adoptive Home
My question involves child abuse or neglect in the State of: Missouri
My Bio Grandchildren were removed from their Mothers home due to her ongoing Mental Illness. They were placed with us for a period of 4 months before CPS removed them due to our violation of the safety plan (we allowed contact with the Birth Mother for one of the children, child was never unsupervised the whole time). Children were put into the Foster Care system for about two weeks before being placed with a family friend. Social workers pressed our daughter into signing away her rights. She did so. The Foster Parents expressed a desire to adopt all three of the children. Adoption was finalized earlier this year. Shortly thereafter the adoption was finalized our oldest Grandchild was murdered by Adoptive Mother. Adoptive Mother is currently incarcerated she is facing Murder Charges & Child Abuse & Neglect. Our other two Bi Grandchildren were placed back into the Foster System. We feel that CPS was negligent in investigating this couple, there were numerous reports made by school officials of bruising on our granddaughter which A mom covered with Makeup. Yet these children were allowed to remain in the home. Photos we saw on the day she died showed a very emaciated looking child, we believe they were also starved. When our daughter agreed to place her children with this family she did not sign up to have her children abused and one of them murdered. She thought she was obtaining a better life for her children, one that she was not able to provide. I am most certain since her rights were terminated she likely has no legal recourse. Is there anything we can do as the children's Biological Grandparents? Can we sue CPS, or the State of Missouri for Negligence? Would we have a wrongful Death Claim? How should we proceed? Our world has been turned upside down since this whole nightmare began. Thank you in advance.
