How to Get a Court Date Moved Up
My question involves child support in the State of: Indiana. Elkhart county to be specific.
So, my ex husband and I went to court July 28 for a modification of support, where he was ordered to pay $150 per week. Two weeks before said court date he quit or was fired. I'm guessing quit since he's not receiving unployment. Since that court date he has paid nothing and is currently 2.5k behind. He was supposed to provide my attorney with insurance info and failed to do so. He also flat out lied about two things. First, he claimed his current girlfriends two children as his own because it lowers his payment to me. Secondly, he told the court he worked at an rv factory. After six weeks of the child support office receiving no word from said factory, I called their HR department to discover he hadn't been employed there since 2013. We went to court today regarding his non compliance and a continuance was made due to bad weather in the area. The problem is the court date was postponed until February. Because he hasn't been making payments im unable to make bills. My daughters need new coats which I can't afford to buy. My oldest needs dental work that I once again cannot afford. I don't even have heat in my home right now. I will be evicted by February. I flat cannot wait that long for him to make his obligatory payments. Is there ANY way to move tr court date forward???? I can't believe they're giving him this much of a break to begin with. Anyone else I know would get work release

You should NEVER base your living expenses on someone else's income. You're obviously living above your own means, so rather than being evicted, you need to work on finding somewhere to live that you can afford.
However, no, based on what you've said thus far, they're not going to advance your hearing date. Even if they did, an order doesn't automatically make money rain from the sky. He could have an order and still refuse to pay it. Then what?

You don't have heat?
It's winter, it's Indiana, and you don't have heat? I suggest you find somewhere else for the children to stay - and find it quickly. Like with Dad.

You should be exploring whether you qualify for emergency housing assistance either through the county or a private organization (such as Church Community Services or REAL Services), and also taking advantage of your state's energy assistance program.
Are you bringing this motion yourself, or are you being represented by a lawyer or child support agency?
