Can a Pawn Shop Have Someone Arrested
My son got arrested for pawning stolen property. The charges were dropped. The item was retrieved from the pawn shop and returned to the owner. The pawn shop contacted my son stated that they wanted the money back or they will have him arrested. He told them that he is not working and need time to pay and if he can make monthly payments. The said no they want the money within 2 weeks or they will have him rearrested. My question is can they do that?

Re: Can a Pawn Shop Have Someone Arrested
In many states, they're required to report the incident to the police whether you pay or not. The pawn shop in most states can't have you arrested, all they can do is report the incident to the police and the police/prosecutor decides whether to charge or not.
Re: Can a Pawn Shop Have Someone Arrested
The facts of the case and of the dismissal can make a big difference. For example, if the charges were dropped by a prosecutor as the result of an agreement by which your son was to repay the pawn shop the money he received, and he has not done so, then it would be likely that a prosecutor would reinstate charges once made aware of your son's noncompliance.

It was his cousin that drop the charges the pawnshop was never involved in the case. I feel like they are bullying him.

Re: Can a Pawn Shop Have Someone Arrested
If the original complainant was the person from whom your son stole the items it is conceivable that the police would accept and refer for prosecution a complaint from a different victim of your son's crimes, the pawn shop. If I were the thief, I wouldn't take the chance.

Just to be clear, your son stole something, brought it to the pawnshop, and received money for it.
Later the item turned out to be stolen, the pawn shop was forced to return it, now they are out money.
This isn't bullying, your son stole from the pawn shop, it would be in his best interest to repay what is owed immediately.
Re: Can a Pawn Shop Have Someone Arrested
He wants to repay but wants to do a payment plan because he don't have all the funds. But they are saying they will only give 2 weeks. That's why I'm saying they bullying because they don't want to give a reasonable time. He also have to pay his cousin for an item that was already sold by the pawn shop.
Re: Can a Pawn Shop Have Someone Arrested
I suggest a family member make him a loan before they press charges and he goes to jail.

So we are talking about multiple items here, how much money doe's he owe the pawnshop and how much to his family member?
