Modification of Custody Denied Despite Molestation of a Child
My question involves a child custody case from the State of: Pennsylvania. My ex and I have joint custody of our 6 yr old daughter. When my daughter was a toddler she was molested under her Mother's care. I had a report from the Dr's office stating this. NO ONE WOULD HELP! Children's Services were contacted, they dropped the ball. The ex was using, they random drug tested me, they told her they were going to drug test her. They allowed the ex to go in the room when they interviewed my daughter, that was wrong. They dismissed it. A 2 yr old doesn't talk about having her p p licked. The DA would not help, State Police would not help. The ex took out a PFA based on lies and I ended up in jail and then prison. My daughter started abusing animals, she wets her panties still, she has uti's constantly. NO ONE WILL HELP.
Our custody order states all educational, religious decisions are to be agreed upon by both parents. Last year the ex agreed to a private Christian School, I worked out payment plan. She paid nothing. This past year she went behind my back, took her out of the school, enrolled her in a school 2 miles from her house and then went and got a court order. I found out about this when a letter was sent to my Mother's house welcoming my child to this school. I got an attorney but it was too late. Things had been filed, paperwork sent to my old attorney (the ex knew I didn't use him). She lied on the pleadings to the court, citing transportation and stating I had enrolled her in the public school where I live. I didn't. She got a court order for my daughter to attend that school for the 2014/2015 school year. I fought it, spent 4k, lost because the Judge said he could not find an emergency and didn't want to vacate 2 orders from another Judge Now I am forced to drive 800 miles a month and spend $200 in gas. I have lost 2 jobs, exhausted my unemployment, struggling to keep my apt and we are on food stamps. I cannot get legal aid, they don't do custody. My daughter is in court ordered play therapy. I have to scrape, beg and borrow my share of the fee. It doesn't seem to matter what I do, somehow the ex prevails. She allowed a man around my daughter that she had has a sexual relationship with when she was a young teen and he was in his late forties. I had to call her parents to stop that man from being around my daughter.
Tonight at drop off, I had to lock my car doors to keep my child from getting back in the car.ll She was screaming, crying and running around the parking lot. When she did get in her mother's vehicle she was banging one the windows screaming Daddy. This happens all the time.
I have seen her have bruises on her face from it being grabbed, bruises on her arms, from them being grabbed, she had bruises on her hiney. I have called Children's Services and NO ONE WILL HELP.
This is just a small portion of what we have been thru. Does anyone know where I can go for legal help? I don't know what to do and I am desperate.

Trumped up harassent charges. I was looking for who molested my daughter and the ex had me arrested. I was asking her friends too many questions.

I'm trying to help you - but if you can't give us the necessary information it's impossible to to help.
Can you tell us under which statute you were convicted? It might change your options considerably.

I set in prison for approximately 6 weeks, all charges were dropped.

I'm going to be as delicate as I can, okay? How exactly did the doctor phrase that statement? I'm going somewhere with that question.
He is a mandated reporter... so did he call CPS?

A 2 year old may well have been coached. But a 2 year old cannot hide physical evidence.

Why do you think you can decide who Mom has around your daughter?

The Dr. wrote that she had credible reason to believe there had been molestation of my daughter after her exam. Yes, CPS in 2 counties was called.
Yes, I tested clean
You cannot coach a 2 yr old to say the things that she said. She first said it to my Mother, "Jeffrey likes to lick my pp" and then told me that Jeffrey hurts her down there and if she told anyone her Daddy was going to be taken away. She also was acting out at this time as well
Her Mother initially filed an emergency petition stating that I had went against the custody agreement and enrolled her in a public school and that transportation was an issue. Neither was true. I had been constantly testing her all summer requesting we talk about my daughter going back to the private school she was enrolled in. That school provided door to door transportation. She would not respond. I think she was already speaking with an attorney. I did text one time and say if I don't hear back from you, I am taking it as your consent to enroll her in public school if I choose.
After I was made aware of all that she had done. I got an attorney and responded too late tho'. Then I filed an emergency petition. The Judge was very understanding, but said he could not find an emergency to vacate the order. He stated he wanted the case back in front of him by the end of Oct. I think something happened because the custody hearing is now set for the end of Jan. 2015.
Let me ask you this, would you want your daughter around a man that had molested her mother when she was in her young teens? This man was a predator. My ex has a long history of poor choices.

This is a horribly one sided story and I honestly don't believe you've been candid enough with answering Doggie's questions which leads me to believe you're answering them in such a way to ensure you continue to look like you're completely defenseless in all of this.
When people answer questions and/or behave like that, I always recommend they consult an attorney so they can speak to them and tell them part of a story for $200/hr.

That's not how it works. There are mandatory protocols which must be followed to the letter whenever there is suspicion of abuse or neglect. Doctors do not "write letters" saying they have a credible reason to believe there had been molestation of the child. If you still insist, and you still have that piece of paper, scan it in and PM it to me - because the physician needs to be reprimanded, and harshly.

And now we're being told that the court didn't see an emergency, after all of this evidence was submitted?
If you want help, you need an attorney. Some of us actually do know what is required and when it's required.

You are absolutely correct it is horribly one sided. How much more candid can I get than to tell the truth? I have to live this nightmare daily and then you tell me it is one sided. Do you not believe there are ever egregious wrongs committed? It is a shame that I tell the absolute truth and have this said. I cannot afford an attorney at this point. I have lost 2 jobs, have sold almost all I can sell and I am on food stamps. I have documentation for everything that I am saying. Do you not believe there is ever a victim, or is it that every victim has to have done something
Would you feel more comfortable if I lied? My ex has ruined my life, she put a fake pfa out on me and stood in a parking lot and looked my Mother in the eye and said "I did it to prove a point, that I could". This is what and who I am dealing with. Have I done stupid things, absolutely, but I have answered and told everything honestly. How can I get help if I don't tell the truth. I AM STUNNED AT THE JUDGMENTAL ATTITUDE. You have no idea what I have been thru trying to get help. Do I get anxious, yes, do I over think things yes, but then look at what you just wrote. I guess I should have lied, I am sorry all that I have said is the God's honest truth.
