Out of State Visitation for Non-Custodial Parent
My question involves a child custody case from the State of: Texas with the non-custodial military parent who has relocated for a job in Tennessee and who will also become deployed in January. Previously, both parents were agreeable to meeting at a half way point between Texas and Tennessee, so that the non-custodial parent could have visitation with child. (The child is 7, and has autism so is unable to travel alone or by air or bus.) As of today, the mother (who lives in Texas) is refusing to meet half way to allow non-custodial parent visitation for Thanksgiving or Christmas holidays or future visitation because she states she does not have to meet him half way and if the father wants to see his child he will have to travel to Texas and bring him back to Texas, all at his expense and time. She states it has nothing to do with "gas money", which was given to her in the past so that she did not have to incur expenses for travel; that this is strictly "principal purposes" and does not have to do anything since the father moved out of state. Does the out of state non-custodial parent have any rights at this point? Is the custodial parent obligated by any laws concerning visitation for the father?

so, what does the visitation order say to costs of travel, meeting halfway, or anything else because that is the only thing that is enforceable. If there is nothing enforceable, then somebody will have to take it to court to seek a courts direction on the matter.

I swear we've seen the OP elsewhere. Huh.

Yeah, we need more details. Start with the parenting plan. If there isn't one, then he needs to file one.

No matter what though, if Dad cannot exercise his parenting time, the point is likely moot.
