    Collecting Unpaid Child Support
My question involves child support in the State of: Missouri

Basically a question for my fiancé. Her ex is behind on child support to her now in the sum of around 10 thousand dollars. What steps can she take to have actions taken? Ex. Warrant for his arrest? Basically he is jumping from job to job, and not supplying his employment information so his wages can be garnished. I thought after 5 thousand behind it was considered a felony. Any information would be greatly appreciated.

What have CSE been doing about it? Do they have the case yet?

(They have a much easier time persuading deadbeats to pay up or else)

This is for Jefferson County; I doubt it will be different anywhere else in Missouri: http://www.jeffcomo.org/ProsChildSupport.aspx?nodeID=PA

First she was told that if she didn't receive any payments at all in 30 days they would take action. She called today (day 30) and was told that they were able to verify his current employment and that the employer has 6 weeks to start garnishing his checks. Before the 30 days of unpayment she would only get 30 to maybe 60 dollars here and there. Other than that they don't seem to be doing much at all. We understand that there are rules and a lot of cases to keep up on but it seems that there has to be something else that can be done.

I'm sorry what is CSE? I know she just calls jeff city. The ones that handle the garnishments through his employer.

    Child Support Enforcement.

From what we can tell not a whole lot. Like I stated first it was if you don't receive any payments in a 30 day period call. After that they said they were able to verify his current employment and that the company had 6 weeks to start garnishing his checks. But as of today he is over 10 thousand behind. We just don't understand how they allow someone to get away with such minimal payments without and reprucussions.

Your wife really needs to speak to a human being at the CSE office.

Otherwise, she may have more luck if she keeps filing contempt in court for non-payment.

She also needs to understand that these things rarely happen automatically - most of the time, A needs to file B in order for Z to happen.

To file contempt of court she would need to hire an attorney correct?

Also, there is an actual family services. "Wic" office right by us. Do you think that going there in person instead of phone calls to the main offices in jeff city would be more beneficial?

WIC doesn't have anything to do with enforcing child support.

Again, she needs to contact whoever it is who has the case. But here's the blunt reality:

If someone doesn't want to pay, they're just not going to pay. If he's already in the hole for $10k, there's a really good chance that he's just going to skip out and onto the next place.

A contempt motion doesn't need an attorney necessarily, but it sounds like she'd be better off having at least an initial consultation with a local attorney.
