Accusing Your Spouse of Forgery of a Check

My wife who is here with a conditional green card signed one of my checks without telling me and cashed it. We live in Connecticut.she has left me and I just found out that she married me to get her green card, there is only three month left for her conditional green card to expire! Please guide me to a right direction and where I have to start reporting this?

if you believe a crime was committed you call the police and report it. If the prosecutor finds there was a crime they will prosecute the case.

If she is not an authorized user on the account, report her to the police and bank.

The immigration issue is separate from the forged check. You do not have to appear to help her remove the conditions on her green card. You should immediately initiate divorce actions if you have not done so. File for possession of the residence. Do not see her alone at any time; the VAWA act and accusations supporting a filing under that should be a concern. You can try to report her to the authorities for a fraudulent marriage but that is a very difficult thing to prove.

The most important thing is to protect yourself from further financial abuses and against charges for domestic violence.

I just want to note that T53147 is offering great advice when he/she noted you should divorce immediately, move for possession of the home and separate, not being anywhere alone with her where she could allege spousal abuse and claim citizenship under VAWA. I was not going to mention the issue myself being considered an extremist, but since our middle of the road member did I agree 100%.

isn't there something in the means of sponsoring a person that commits them financially to support that person for a number of years, whether they live with them or not? I recall (maybe) Dogmatique speaking of some requirement along those lines.

I am wondering if this is a joint account, or, if this is something she has done before with your permission?

And what check did she sign? Was this a paycheck or other check made out solely to you? Would it normally have gone into a joint account? Has she signed these or similar checks on your behalf, before?

Merely signing the check and depositing or cashing it is not not necessarily a crime. A lot more detail will need to be provided in order to make that determination.

Yes, that is why our esteemed fellow member who is well versed in immigration law , mentioned the steps OP needs to protect himself to have her permanent green card hearing fail at the 2 year mark and her be deported. VAWA is an affirmative circumvention of that if she claims he beat, abused or continued to live in a valid marriage situation.

Sorry not giving enough details, I just wanted to know if I could use this fraud that she has committed can be part of her deportation? She has left me with accusation that I abused her in this relationship! Doesn't she need to show records of me doing that by the police report? Can she really just go there and say he abused me without any records? On the other hand I just found out that she has been telling all my friends that I always abused her physically and mentally. Please respond. Thank you
