False Report of Car Theft by an Ex-Girlfriend
My question involves criminal law for the state of: Las Vegas
My husband was arrested last year for auto theft, I don't know all the details. However it involved a upset girlfriend who reported her car stolen even though she allowed him to use it. He already served sometime for this, and was to return to court several months later. He forgot about it, as we live out of state and didn't receive notification. I found out the other day that he now has a bench warrant. What can we do to resolve this issue?
Re: False Report of Car Theft by an Ex-Girlfriend
He should speak to his criminal defense lawyer.
Re: False Report of Car Theft by an Ex-Girlfriend
He doesn't have a lawyer at this time.

That was a subtle hint. He needs to get a lawyer in the Las Vegas area to assist him with clearing this up. Whether that will be having to surrender himself and be bailed out, pending further court appearances, we cannot say.
You stated he was not notified of the court proceedings he missed. Did he have an attorney at that time and/or was the court aware of his out-of-state residency?
Re: False Report of Car Theft by an Ex-Girlfriend
I didn't intend for the hint to be subtle. There's a lot more to the story than we've been told (the guy isn't even willing to tell the full truth to his wife), it's reasonable to infer that the guy a criminal history that involves considerably more than this car theft conviction, and he could be looking at serious consequences for somehow "forgetting" that he had to go to court.

He needs to hire a criminal defense lawyer NOW.
He's sitting on a ticking time bomb.

I was being facetious. I knew you were being as subtle as 2x4 to the head.

Guess this was the wrong place to come for help!!! I thought this site was suppose to be helpful not judgmental!!!!!! I know the whole story was simply sharing the basics! He does not have a criminal past..simply made a bad choice! I realize you guys are perfect and probably dont understand that!
Re: False Report of Car Theft by an Ex-Girlfriend
You seem to be taking way we view routine, personally. You are missing the points of information you needed out of this. 1. He needs a lawyer and to appear in court on the charges. He did not just forget, he fled. 2. There is more to the girlfriend just got angry story than he is telling you. No one knows what it is, but the story is not entirely true. He made more than one bad choice, that is apparent. No one here can list the specifics though. Your welcome, sorry you thought we were going to have some profound get out of jail free idea. the world seldom operates that way.

There's no judgment in telling somebody who needs to talk to his lawyer that he should talk to his lawyer. As he won't even share the facts of the incident with you, there's little else we can do.
To put it mildly, if he spent time in jail over a dispute over a car that was entrusted to him by his girlfriend, in a he-said, she-said about when the permission ended, it's difficult to believe that he does not have a considerably longer criminal record.
