    Extracting and Using Data from Reports
    Hi All,

    How do the rules/law apply to extracting and using data from reports and collateral compiled by agencies such as Forester, Gartner, Nilesen, etc?

    For instance, many people use facts, statistics, data and quotes from their reports in articles both on and off line.

    Would it be acceptable to extract all of the facts, statistics, data and quotes from these reports and make them available in a database?

    Although facts and data are not of themselves subject to copyright, protections can extend to the presentation of the data, and to compilations and to the content of databases where the author has made creative choices about the selection, coordination, or arrangement of the facts or data.

    But that's not the end of the analysis. Providers of valuable data often bind their subscribers by contract to limit the manner in which they use and share the data. It is possible for somebody to utilize proprietary data without violating copyright laws, yet still find themselves subject to litigation based upon the claim that they've misappropriated that proprietary information or that they are using it in violation of their contract with its creator.

    Depends on why and how you will make this data available.

    If you are doing it for money, you would likely have an infringement issue.

    If you aren't doing it for money, you might have the issues mentioned by Mr K.

    I disagree with Jack on this one. Mr. K has the correct analysis whether you are doing it for money or not.
    If you have a contract that says you won't disclose it, you can't violate that contract. Usually they don't want you divulging the information even for free.
    The copyright (which applies to the expression but not the data) doesn't care if you're making money or not either.
