    Child Support Modification for a Half-Time Dad
    I have a six year old daughter who I spend as much to as possible with. I've recently moved to make sure that she still attends the same school because her mother wanted to move out of district. We split our time with her 50/50. Her mother pays for her health insurance but I have been paying $400 to $470 a month to my ex despite being a half time dad. My ex is constantly threatening to take my child away from me and has taken some of my time in order to punish me when I don't do as she asks. We have never gone to court but she keeps telling me they would take my daughter away from me. I have no criminal record, don't smoke or do drugs, have had a stable job since before my child was born, and I love my daughter very much and have a very good relationship with her. I need to know if going to court could hinder my time with my daughter but being a half time dad I also want to know what I am obligated to pay my ex.Also our relationship was ended by her after I found her with another man in our home- I don't know if that would help my case at all in court but the fact is I would have never given up my daughter by choice. Her mother and I were never married as well.

    Without knowing the state this is happening in, all that can be offered are generics.

    Court orders protect everyone.

    I agree that without knowing your state, its hard to give you much information...but I can give you some.

    If you make more money than mom, and particularly since mom is paying for the child's health insurance, it would be normal for you to have to pay some child support. A 50/50 timeshare does not equal no child support.

    You would have a decent shot at maintaining 50/50 in most states since you can demonstrate status quo.

    Go see and attorney, come up with an enforceable parenting plan and request joint legal custody. In your parenting plan, include the often missed details like who is responsible for pick up and travel, ask your attorney about ROFR , think about using My Family Wizard (offer to pay - it's $99/person/year but it's a sanity-saver in many cases), and head on over to deltabravo.net.

    My question involves child support in the State of: new york

    My ex and I have a six year old child. We split our time with her evenly. There is little difference in our incomes. I have always paid support ever since she broke up with me a few months after I caught her cheating. However, I've always had my daughter as much as she has and her rates that she considers fair have sky rocketed. I used to pay $250 a month to cover her insurance and then id pay for extras like clothing or doctors visits. Then it changed to $470 and now it's at $400. I provide all the necessities for my child when she's in my care. What I really want to know is, is it possible to actually split all my daughters costs down the middle or do I have to pay for everything from here on out? Also my ex recently moved out of her mothers to a more cost efficient area so I moved into my daughters school district to make sure she stays in a good school. Now her mother refuses to give me her new address. I find it strange that she's not willing to give up this information because she's is always well informed to where our daughter is and my new address. Can she hide my daughters address from me?

    Without an enforceable court order mom can move kiddo anywhere she pleases.

    Go to court
    Get an enforceable parenting plan
    Get a child support order

    My question involves child support in the State of: New York

    My ex and I have a 6 year old. She broke up with me on our daughters second Christmas- two months after I caught her cheating on me with another man. Needless to say I was never willing to be without my daughter. I have paid monthly child support ever since. Our pay is about the same and we have our daughter the same amount of time. However my ex does have my daughter on her insurance ( she has dental and vision and I don't) so I'm more than happy to pay for that. I had been paying $250 a month plus extra if she had doctor visits or needed new clothing for school- even though I supply her with all her clothing and needs at my home as well. Over the years my ex wanted more and raised it to $470 a month and now now for the past year it's been $400. She threatens to take my child from me if I don't do as she says. I've calculated my child's expenses, minus food and clothing because we both provide that separately, and I am paying for almost everything. Money has been tight lately cause I moved out to keep my daughter in her school district because my ex wanted to move out of her mothers. She moved somewhere more cost efficient but the schools weren't as good. We have never been to court and had never been married. I want to know if going to court would help or hinder me and if there is anyway we can split my daughters costs 50:50 as well
