Drug Possession Charges With an Incorrect Field Test Result
My question involves criminal law for the state of: Texas
I had police come to my house because of a family problem. My father just wanted to get me out of the house. The police searched me and found a bag in my wallet containing approx 36 blotter papers they suspected to be LSD. They did a marquis test and it came out as methamphetamine. However I am positive that it is not meth, and is a research chemical 25i-nBOME. When asked what it was I simply said it was acid and not for human consumption. Can I get the charges dropped since I was charged a wrongful drug? Im positive if its tested it will come back as 25i-nBOME and not methamphetamine. The charge is Poss of CS PG <1G (State Jail Felony).

"Mistaken" does not equal "wrongful."
Guess what, that drug is also ILLEGAL. This drug was added to schedule I last November. You're still guilty of the offense even if they are mistaken about the particulars. You need a lawyer.

Your lawyer can request the drug result from the labs,chance are something illegal is there.
