Child Has Lived with Me (Noncustodial Parent) for Over a Year
My question involves a child custody case from the State of: New Jersey
My divorce was final in July 2012. When we had separated previously, I had been told to go live with my parents in NJ so that we could work on working things out. They did not happen and when we completed the divorce through mediation, we agreed to joint legal custody with ex husband having residential custody because he lived in Florida where the children were attending school and had friends.
In Spring of 2013, ex husband decides to move to VA in the coming summer. My daughter, age 13 decided to ask her father if she could live with me. She wanted to attend a special performing arts school in my area for high school and wanted to get to know her new sister. After much discussion and negotiation, my daughter moved in with me in July 2013 and ex husband moved to VA. He has not financially supported her in any way since moving here.
Every time I mention a modification of custody, my ex-husband becomes angry, threatens to take her back and has called my parents several times saying what a poor parent I am. In the spring of 2014, he called and said not to be scared of him. He added that he now wants to make things official and filed things in court to honor this modification. I wait all summer for a case number or some information. Last week, I texted him if he filed yet and he said that the check just cleared. I'm pretty sure that the court doesn't accept personal checks.
I am scared of retaliation, but I really feel I need to act.

So dad is in VA now and has been since summer 2013? You might have a basis for having jurisdiction switched to your state since your daughter has been a resident there for over a year and dad is no longer located in the original home state.
