Getting Custody of Children After Their Parent Goes to Jail
My question involves a child custody case from the State of: Texas/Louisiana
I have a Niece, Nephew, and great niece in states custody in Louisiana, been there 2 weeks today. My husband and I live in Texas. The situation is a little complicated. My sister in-law is in jail (facing 200 years if convicted, mother of Niece and Nephew) and oldest niece is in prison (mother of the Great niece). The Father of my Niece and Nephew is in prison in Texas, his family wants nothing to do with the children. The believed father of my Great niece is an illegal from Honduras. We have tried to talk to the case worker many times, but we get the same story "I can not discuss case matters over the telephone" and rudely hung up on. We just want the children home with us. what are our options?

All you can do is try to persuade the caseworker that you're an appropriate candidate for placement.
There is every chance the children will not be placed with you, but this is really something you can't do on your own - you should have at least one discussion with an attorney who can guide you further.

You should look for an experienced family law attorney in Louisiana where the children are located. If anything can be done, and it is possible that it can be, you will need an attorney there to start communicating with both parents and the courts first to file a petition to establish standing on your behalf, and then the state agency caring for the children. The sooner you do this the better.
