    My question involves public health law in the State of: Ohio. Recently my stepson brought home a paper from his elementary school stating he was in their system as recieving welfare benefits. At first thought it was an error on their side, however then I thought about when I took him to the Hospital for some testing and they mentioned he had medicaid. I told them no he doesnt, my husband is in the military and he has tricare health insurance. So we called the local welfare office and they took all of our information, but couldnt tell us anything. Still not being satisfied, I thought about it all night and the next day I decided to call the medicaid hotline and check my stepsons eligibility. Since the welfare office couldnt give out the information due to privacy laws, I was hoping the medicaid hotline could tell us yes or no if he had active medicaid. Just as we were suspecting, yes he did in fact have an open medicaid case. Which also more than likely means theres an open food stamp, cash assistance, etc case as well. I was able to do some digging and find out it was my husbands ex wife (my stepsons biological mother) who filed for benefits over 14 months ago! She has not seen him since his first birthday, over 7 years ago. Also she has not paid a dime for child support and is court ordered no contact with anyone who lives in our house. She does have a previous felony from drug trafficing charges back in 2011 and just got off probation in June of this year. My question is, what will the state of ohio do in terms of investigating and when they find she frauded the system, what kind of punishment will she get? She has a lenghty criminal record and drug abuse and already entered rehab during her court issues back in 2011. We have been told she is now using drugs yet again. We are taking all our the documentation down to the welfare office first thing tuesday morning, but Im curious what to expect next. This broad has been a pain in the butt in our house and is only going to get worse in my opinion. Any opinions or advice would be greatly appreciated. Thanks!!

    She will likely be charged with fraud, jailed and ordered to pay restitution.

    Will it be a felony since its over $500 she recieved in benefts? Shes been getting it for almost 15 months. Also, we have been told theres an electric bill outstanding in my stepsons name and hes only 8 years old. We have not confirmed that yet, but are working on finding out if that is accurate or not. How long would it take for them to file charges if we provide all documentation needed to prove she lied to get welfare?
