    Child Name Change in Florida
    I live in Florida and I am not married to the father of my son. His father is not a nice person and has done some really rotten things in business to hurt people. I do not want my son to have his name. Do I have to have the father's consent even though we were not married to change his name? His father's name is on the birth certificate. Please help.

    You will need to either have father's permission to change the name, or file and ask the court to order it. Either way, the father must be notified. You can file for this at the same time that you file for CS.

    In florida, if the baby is less than one year old you can do a 'correction to birth certificate' and change the name. Both parents must agree/sign notarized form you can get on line and submit directly without court involvement. Maybe at the very least he will agree to a hyphen on the last name. Good luck.
