    Since when is mental illness not a factor in child custody cases? Since when is it better for a child to be with a mother who yells and at her or starts arguments or (best case) ignores her, rather than a mentally/emotionally stable father?

    At what age does the child have to be for a FATHER to be taken seriously as a parent by the court?

    Re-read what I actually said.

    Mental illness becomes a factor if there is actual proof that such an illness is causing the child harm. This is nowhere near as easy as most people think. Perhaps a custody evaluator should be brought on board. Certainly, a GAL wouldn't hurt you.

    Come on - do you honestly believe that a bad temper renders the parent less fit than the other parent?

    From day 1 right up until 17 or so.

    You've got to be SO careful when you are so intent on using Mom's mental illness against her.

    If you knew beforehand, then you made a lousy decision in making her the mother of your child.

    If you didn't know beforehand, you've stuck around and let her mother the child - and that's a very clear message you're sending to the court.

    If all you have is Mom being a bipolar patient who has a nasty temper, you're not going to win this one.

    So. Let's move past mental illness. Custody will be based on "best interest" - so what do you have?

    I most certainly did not know about her mental illness beforehand and can prove it.

    So are you saying that because I tried to help my wife by sticking with her while trying to raise our daughter as a family, and trying to get her help...that would count against me in court?

    You can raise your allegations about your wife's mental illness, and the effect you believe it has on her ability to parent, by submitting appropriate evidence and testimony at trial. The court will consider that evidence, along with all other evidence and testimony submitted, when evaluating what outcome is in the child's best interest.
