Can You Use the Name of a Sporting Event As an App Name
I wanted to know if I can use the name of a Golf tournament in the name of a mobile app that I'm developing.
The app is a Golf quiz app, can I name the app "US Open Golf Quiz"? Would that be fair use or infringing on a trademark? The name also appear once inside the app as a title but it does not contain the logo as shown here and states that it is not affiliated with the organizing body. The app is free and contains ads.
Thank you in advance.
Re: The Legality of Using the Name of a Sporting Event As an App Name
The only live trademark I found on the USPTO website is U.S. OPEN GOLF COLLECTION, serial # 75153745, owned by United States Golf Association AKA USGA CORPORATION DELAWARE Golf House P. O. Box 708 Far Hills NEW JERSEY 07931. This is by no means an exhaustive search so do your own due diligence.
You can write to their legal department and ask them for permission to use it or if they will consider it an infringement.
Or you can consult with a trademark attorney for your answer.

By the way, fair use is for copyright not trademarks. You are either infringing or not.
