In small claims? You can't do that in ANY of the states around here. A manager might be able to FILE an action, but when it comes to the time that someone needs to stand up in court, there are very specific rules as to who that can be.

My experience is in California, Nevada, Arizona, Colorado, New Mexico, Texas, Michigan, Arkansas, Florida, Ohio, New York, New Jersey, Maryland and some others. In all of these states, store level LP has filed and appeared in the behalf of the retailer. All they need is a letter from corporate making them the authorized agent of the retailer.
Once again, I have NEVER used an attorney to file a civil demand action or to appear in a small claims court case. Small Claims courts are setup to be user friendly. I've even sued in Small Claims Court on non-civil demand cases
