    Is It Illegal to Carry a Prescription Medication Around Without Original Container
    My question involves criminal law for the state of: Indiana

    Is it legal for a probation officer to keep an offender's medications in the office? Is it legal for a probation officer to give an offender their presciption medication and let the offender LEGALLY walk out of the office with the medication in hand and the original dispensed prescription bottle to be left at the office? Sounds illegal, as a controlled IV substance should be in it's original dispensed container while traveling outside of home? The medication being class IV(xanax)

    Generally, the issue is that if you are caught with the drugs and not the bottle, you will be charged and must go through the process to prove you were prescribed it and that what was seized was the brand dispensed.

    For example, I sometimes move an almost empty opiate bottle into a new one by a different manufacture to carry around. I keep the old bottle corresponding with the correct manufacturer until I have finished the last few from it.

    As previously noted, you can be charged for carrying it that way but I know of no law that prevents the probation officer from keeping your medication and dispensing your medication to you one at a time.

    It makes even more sense if you are on probation for a drug related conviction.

    If you are concerned with the legality of carrying it like that, why don't you just take the medication before you leave the office and don't carry it around with you.
