Emancipation Law in Iowa

My question involves juvenile law in the State of: Iowa
Allright. So I know there is quite a few emancipation threads on this forum, but I needed some advice.
I am 16 years old and currently living with my boyfriend who is 18. I am a CNA (which I achieved living on my own) and he welds so together we make $29/hr. We are pretty much husband and wife and we always budget our lives accordingly to our expenses.
I've been living on my own for 4 months now, and I have been gaining independence since I was 14. My father never had a job and my mother worked at Wal-Mart until she quit last year, so neither of them currently have jobs. They split up about 2 years ago and she went and got pregnant by a 19 year old, and I never really heard of her since. My father went out with this woman and a month later they've moved in together. She has 2 children and my father has 3 children currently living in the home. She works at Caseys but he still is unable to find a job.
So, furthermore, I just needed to know what the chances are for emancipation for me. I want to be able to rent an apartment by my own, assign doctors apointments, get a bank account of my own, etc. My father did at one time agree to the emancipation, but now he is in disagreement since he realized he wouldn't be getting any government aid from me anymore.

In Iowa you have to be at least 16 to petition the court for emancipation. You've met that requirement.

Other requirements are that you demonstrate:

Financial self-sufficiency, including proof of employment or other means of support, which doe not include assistance or subsidies from a federal, state, or local governmental agency.

An ability to manage the personal affairs of the minor.

An ability and commitment to obtain and maintain education, vocational training, or employment.

You appear to have met those requirements.

Fortunately, according to statute, you do not need parental consent if you can show either of the following alternatives:

(1) Documentation that the minor has been living on the minor's
own for at least three consecutive months.

(2) A statement explaining the reasons the minor believes the
home of the minor's parents or legal guardian is not a healthy or
safe environment.

You would likely want to address both in your petition.

There doesn't appear to be a pre-printed form on the Iowa court website:

So you'll have to create one that includes the information required by the statute. You can probably google Petition for Emancipation and get some samples from other places that you can reword for your local court.

No guarantees, but you might be closer to qualifying than most teens who post about emancipation.

Your combined income is irrelevant. It appears the current situation is you have parental permission to live with another adult. You have not established that you can afford to provide for all your own needs on your wages alone.

Good point.

But the Iowa requirements seem a bit more liberal than others I've read.

Might be worth a shot.
