J1 Visa Denial Under INA 214(b)
Hello,
I went to my interview yesterday and got denied under 214b article.
I could not convince the officer that I was qualified for the training. The Officer asked if I had a resume with me which I did not have as I thought he had that from my application through the sponsor.
What can I do? I'm trying to contact a lawyer
Any advice?
Thank you
Re: J1 Visa Denial Under INA 214(b)
You were denied as the interviewing officer thought you were a potential immigrant. Is there anything in your background - such as a family member who came to US on J-1 or F-1 - and filed for a green card?
Re: J1 Visa Denial Under INA 214(b)
Thank you for your response.
All my family lives in France and never applied for any visa.
I was before with a F1 visa, and my OPT ended on June 30th. I never overstayed or anything.
I could not even show proofs of ties in France as the officer stopped me when I was explaining my project. On my My Ds-160, he could see my last 2 jobs which were on my OPT, he could not see the 2 jobs that are related to my training. I wonder if I should have entered the 2 related jobs on my Ds-160 instead of the ones on OPT which have nothing to do with the Training. What do you think?
Im trying to get in contact with lawyers and it seems complicated to get a hold of anyone.

Why J-1 rather than applying for H-1B?
Re: J1 Visa Denial Under INA 214(b)
I don't have a Bachelor or a Master degree. I only have an Associate's degree. My only option is a J1
Re: J1 Visa Denial Under INA 214(b)
An associate's degree does generally not open that many job opportunities; it is generally a stop on the way to a bachelors. It is particularly true for international students.
I believe the official saw you trying to work illegally and mark time to find a way to immigrate through marriage.
While this may not be your intent, you are judged by what those who have come before you ended up doing.

Thank you all for your input.
I will get the help of a lawyer and will try again some other time.
