    Caught in a Sex Act in a Parking Lot
    My question involves criminal law for the state of: Idaho

    A friend of mine was in a parking lot with her boyfriend who she hadn't see for a long time. They were going to go inside and eat lunch however started kissing and such in the back seat of her car. Things somewhat got out of hand and a waitress came over and knocked on the window and asked them to leave. Immediately (she had a shirt and underwear on) jumped into the front seat, pulled out, and left completely embarrassed. While she was leaving she noticed the waitress was writing down her license plate number. She is completely panicked about this. What can happen to her/them? Can they call the police and do something about this? What would be the time frame? Will the cops come to her house since it was her car?
    She was stupid, and knows she will NEVER do that again. I feel bad for her, and just want some advice.

    If a little hanky-panky in a car was a serious crime everyone born after 1950 would have a criminal record.:)

    Tell your friend not to worry. The witness asked them to leave and they did. I doubt that witness will want to press some sort of charges that the police will follow through on.

    I guess why she is so freaked out is because she saw her writing down her license plate number, what would be the point unless she was planning on taking further action. And if the witness calls in the police and explains what happened, what will they do?

    There is no possible way for us to know what the police in an unnamed location will do about an unspecified report.

    I understand, clearly this is hypothetical about her calling in a report. Just wondering if the cops would do anything if she actually did call into the police, since they left right away?

    The police response could be anything between nothing and coming to arrest them, or anything in between like coming and telling her to keep it private next time.

    If the police investigate, the first thing they are apt to do is to try to get a confession. So the best thing that the couple can do is to decline to make any statements if contacted by the police and, if the police seem insistent or threaten charges, to lawyer up.

    She should relax.

    Unless they were nude in the car, making out is not a crime.

    All she can do is wait and see what happens. The more time that passes, the more likely it is that nothing is going to happen.

    It would only be a crime if the person who observed it saw the nudity and reported it to the police. Even then, the police are not likely to pursue the matter unless they are really, really bored ... and the complaining party can identify the man she saw nude. I doubt it would be worth their time and effort.

    As a matter of law and generally speaking, police seem to view these incidents as more amusing than criminal. Unless they have a vehement witness who is highly offended I don't see it going far.

    And perhaps whether it happened in a McDonalds or Chuckie Cheese parking lot during the day, versus a restaurant/bar parking lot.

    God has a naughty list somewhere with my name on it. Church parking lots and drive ins were convenient when I was young.
