How Can I Get a Job Working with Children with CPS on My Background
My question involves child abuse or neglect in the State of: TX
I really desire working with children, and I am looking into becoming a teacher’s aide soon. There is one big problem! I have cps on my background! I never abused my child or anything of that nature but it does say on my case that I've neglected my child. Really it was due to miscommunication between my parents and me. My case is only a year old and I’m trying to get into a career like job. My question is, how can I get a job working with children with that on my background? I will look into getting it removed once its 3 years old (I was told that I should wait for 3 years to get it removed) are there any helpful tips? Please I desperately need your help! Thanks!

Given the nature of the crime, I don't see working with children is on the cards at the moment.

CPS case records in Texas will not show up in a background check. A CPS finding does not establish guilt of any crime, as only a court can do that. If a criminal act occurred, CPS would have referred you to authorities for prosecution in a court of law.
Answering NO to any questions regarding arrests or convictions, if you were not arrested and as applied to a CPS finding alone, would be truthful.

Who will know what is in CPS records about me?
Because Texas law requires CPS to keep the report and investigation confidential from the public, CPS will only give information to the people who were investigated, the victim's parents, law enforcement officials, courts, and county or district attorneys. There is a very limited exception for certain details about a child death investigation, which must be released to the public, and CPS will share information with providers and others as necessary for services to be provided. For example, a therapist will need to know details of the abuse and neglect to provide counseling. CPS will give relatives or other individuals with whom a child is placed any information necessary to ensure that they are prepared to meet the child's needs. This may include information about any abuse or neglect. The law does not allow CPS to give you the name of the person who reported the child abuse or neglect.

I have cps on my background!
By that, you mean that your name appears on the central registry?
tex11, presumably we're talking about a background check under Sec. 42.056 of the HR Code.

When OP stated being a "teacher's aid", I did not see that in the context of a child care facility but rather the preK-12 educational system, of which 42.056 does not apply.
But my initial response incorrectly implied CPS case records are confidential in EVERY employment situation.
Though there is nothing in 42.056 which suggests that being on the registry automatically bars one from employment in child care facilities. In this case it would depend upon what exactly the finding of neglect was based upon, other relevant facts, and the employment standards of the day care center.

The exemption for public schools can be lost, for example, if the school offers before- or after-care. It's not uncommon for schools to offer that type of program.
