    Ok, my son, 15, never in any trouble, recently was charged with criminal tresspassing. He apparently, with 3 buddies, opened the window of a closed down old school building that had just been sold to a private owner and went inside to ride his skateboard. They did not steal or vandalize, just skate. Someone saw them and reported it. The police went to the school and pulled the boys out seperately and interrogated them all. They did not notify his mother or me, except for the school principal calling and leaving a message on our voice mail to "contact him at the school". They got the boys to admit what they had done and said it would be handled by the school. They suspended him for 3 days. Next thing I know, court papers show up. Charged with criminal tresspassing and im assuming they will go for the 4th degree seeing as how it was an OLD, no longer used school building. But it had been sold weeks earlier. Any idea what kind of trouble he is looking at here or how to play this? I appreciate any help.

    You used the terminology "Trespass 4" That said, I'm going to use MY state, WASHINGTON as a point of reference to my answer.

    Assuming the terminlology as related to statutes is in fact similar, I think that's safe but check your own states stattutes.

    "Trespass 4" Class "A" Misd. Punishible of a MAXIMUM sentance of 1 year County Confinement. (ADULT) Necessary elements - Simply put, the accused only has to "Break the plane" of any described property, (Definitely an old school) This means, literally, just sticking his hand through the window technically would meet the requirements. Your son is really lucky that the D. A. didn't charge him with Burg II, yes!, II, because alot of times Schools are catagorised with commercial buildings, therefore II, not the lesser 5 YEAR FELONY of Burglary in the third degree.

    Note: MAXIMUM "Trespass IV" - 1 year county)

    That said, any attorney has to tell you that any deal offered and accepted between councel is not final to the presiding judge unless specificly and in writing states so. Means, you always have to remember that until the judge states otherwise, that year is probably gonna be over someone's head.

    FIRST TIMER? First of all tell him he was a VERY bad boy!, Naw, assuming he pleads it out, as long as the two of you show that you are aware of the charges, understand and agree that the state had cause, introduce positive evidence showing community support, family, evidence of changes in behaviors will prevent future ???, Show remorse, and mean all of this, I see nothing more than a very stern talking to by the presiding judge, maybe a little collar of probation if the judge is just tired, or maybe on if he just want's to keep an eye on him. No jail, Unless there's past history......

    Either way, stick by him until it invades your life to any point that you or anyone in your family is moderately effected. At that point, I feel it is ok to distance yourself, family, friends, ??. but that's only if things get way out of hand. Your description of everything to me so far doesn't go there.

    If you're speaking of trespass, the fourth degree misdemeanor, under Ohio law (Ohio Code §§ 2911.21; 2929.24; 2929.28), the maximum penalty appears to be a jail sentence of up to thirty days and a fine of up to $250, although juvenile courts often have more flexibility in fashioning what they deem an appropriate sentence than a statutory penalty might suggest. With no prior record and no harm to property, a juvenile court is likely to order probation.

    Do you think the Father's kid can be Reprimanded, Because many websites and stuff will give you a warning the fist time you violate their Code of Conduct and the second time you do it they ban you from the site,Because i believe people should be given a second chance like a warning and if they do it a second time they ban you.
