How to File for Full Custody
My question involves a child custody case from the State of: Tennessee
When my Ex and I got divorced we worked out a verbal agreement on our 4 (now almost 5 year old) daughters care. Now she is refusing to let me come get her at the end of her time. I am moving to Alaska for work and school and plan to still work out visitation but my Ex will not let it happen so I need to file for full custody. I was being nice by splitting custody with her mother evenly. Actually, my daughter was only suppose to be with her mom for supervised visitations but the grandparents had to go back to work so they gave her back to my Ex full time. ... My ex is an addict about to give birth to a very sick child. She says she is clean but there is no proof. She hasn't had a job in almost 2 years and lives off the government and her parents. And has domestic violence charges from 2011 and some other criminal issues going on. I know I can win in court. But I have no idea what papers I have to file to get the process going. Please help.

How long has she been back with Mom (unsupervised), what have you done in the meantime and what are your reasons for requesting full custody?

Dad, you are moving to Alaska...full custody is not a slam dunk for you...particularly if status quo is 50/50. You say that there is no proof that your ex is clean, but what proof do you have that she is an addict? And addicted to what?

And were the supervised visitations court ordered? Do you have any child custody/visitation agreement that *is* court ordered? If so, what does it say, word for word? (leaving out identifying information)

Nothing is court ordered as far as the visitations and what not go. MY Ex signed away her rights in juvenile court when our daughter was 8 months old. To her mother. When we gave her back for the summer she was in her grandmothers care and her grandmother (my ex's mother) made the decision that my ex could only have visitation when on of the grandparent were present.

I'm not nearly as convinced as you seem to be, that you "can win".
But please clarify EXACTLY what you mean by "My ex signed away her rights...".

Ok...this is getting even more confused.
Based on that, it sounds like grandma has custody legally and that it was grandma being nice splitting time with you. Seriously, if you cannot clearly explain the legal status of everything to us we are not going to be able to give you any decent advice.
