How Much Notice Do I Need to Give My Ex- Before Moving
My question involves a child custody case from the State of: Ohio
My wife and I live in Ohio and are not yet legally divorced. We have lived in separate households for some time and have agreed to a 50/50 split in visitation with the children. Our households are about five blocks apart and in the same school district. I am planning to move residencies, remaining in the same school district. Keeping in mind that no divorce documentation is binding at this time (hopefully soon, though), how much notice do I legally need to give her before moving?

There are no rules on this providing all of your visitation/custody has been kept between the two of you. How far apart will you be after you move?

We will be living about a mile apart, much the same as we are now. Same school district, same area. I will be meeting with my attorney about it, as well. I just wanted to get an idea of what restrictions might be in place before I met with him. Thanks for your input.

Why don't you just ask your wife how she feels about it? (or just let her know your plans) She may be perfectly fine if things are as you say, and you don't have to pay your attorney more money.
(the more things you can work out amongst yourselves, the better off you'll both probably be.) (except when there is a lot of money/property involved. Then you both need your own separate attorney to look out for your best interests)

I agree with the others. Its way overkill to get your attorney involved in a move that will only place you one mile away. I cannot imagine your wife even attempting to object (unless you are leaving out critical information, but I cannot imagine what that could be either) and she certainly wouldn't get anywhere with objecting.

Will this result in change of method in how the kids get to school? I know my neighbors ex lives next to the school and their kids walk. They bus from her house. Will this put them in an unfavorable transport situation?

No, no transport issues at all. I am gathering that this move is not a very big deal from a legal standpoint. Thank you all for the input.
