Re: My Assault and Battery with a Deadly Weapon Possible Outcome
I have been refused service at the drive thru twice. The first time, even though there were several employees working, they declined service because I walked up, even though I explained I had a tractor trailer parked 1/2 block down the road. So I went and got the tractor trailer and drove it up to the order post and as close to the drive thru window as it would fit. All the employees working and customers in cars were laughing their butts off. The second at another major chain the woman refused to serve me because the tractor trailer would not fit up to the drive thru window. When I questioned why that mattered, since I obviously had a vehicle......
Drum Roll Please.............. She said I might have stolen the tractor trailer to try and use the drive thru and might rob them.

Coincidence. They take their fast food service quite seriously in Mass.

That's fine however, in your infinite wisdom(and probably unbeknownst to your counsel,) you took upon yourself to detail your own inappropriate behavior on the internet. In honesty, you version matches up well with the police report version posted in the media. It also fills in the blanks and makes you look worse than your original version...

Evidently they take Taco Bell much more seriously in Western MA than they do at my end of the state. I personally prefer KFC.

    Legal advise aside.
You pulled out a BB gun as a form of self defense in an attempt to scare someone during a confrontation.
Mr. Drunkman doesn't see a BB gun, he sees a deadly weapon and is suddenly fighting for his life.
Be glad he was not carrying an actual firearm or other weapon because when you pulled out your "deadly" weapon you really upped the scales.

    I call that stupid.
    Others call it Natural Selection.

Juries call it "escalation, not self defense".

At this point, there is no proof of the victim being drunk. At this point there is no indication that he was "allegedly" drunk except by the man that has admitted to shooting him with a BB gun. Dude needs a lawyer ASAP!
