Permanent Resident with Felony
My husband has been living in the states with his family since he was 4. His dad one the citizenship lottery in Indonesia so they are all here legally. In 2007 or 8 he received a felony for possession of steroids and a misdemeanor for possession of marijuana. He went through pretrial diversion and I'm pretty sure it's all
Expunged. A couple of years ago he looked into becoming a citizen so he could do normal things like visit other countries and vote. The lawyer he spoke with told him he is better off never applying for citizenship and continuing to renew his permanent resident card do to his passed. The lawyer said that in an attempt to become a citizenship his thorough background check would reveal his felony and there is a big chance of deportation. Does us being married make a difference? I can't remember if we were married at the time he seeked advice from this lawyer. His sister is planning to get married out of the country in a year and would really like him there. Does anyone know anything about this issue? I'm
Scared for him to really look into and get shipped back!
Re: Permanent Resident with Felony
He really should consult an attorney experienced in these types of issues for a second opinion. The question is too important to depend on the answers on a forum even though the posters are generally knowledgeable.
He needs to take all of his court documents with him.
