Harassed by Somebody in Another State
My question involves civil rights in the State of: New York

    - - - Updated - - -

I'm new to this site so I don't think I posted the thread right...

But I just have a question regarding laws in New York City. I've been being harassed any threatened by someone who lives in a different state. I've recieved many calls from unknown numbers, anonymous texts w threats, calls from strangers, angry violent emails and have been slandered on the internet. Does any of this qualify for a restraining order, or civil harassment order? I've attempted to block all the numbers I'm called from, block all social media sites along w try to contact her superiors at work. I just want this all to stop and I don't know where to start. If anyone can point me in the right direction id appreciate it!

Any idea what started this harassment? If I were you, I'd stop using social media and consider a change of phone number and email address. Only give those out to people you trust and those who must have that info.

Others will advise you further on restraining orders and applicability of same.

If your username is your real name, I'd advise you not to make any further posts because this board is google searchable and you don't have to be logged in to see what people write here. Your harasser could find you here.

Do you know who it is? What is the nature of the emails?

Are you willing to travel to another state to pursue the matter? The state YOU are in has no jurisdiction to tell a person in another state to stop doing XYZ. If you want an order that can be enforced, you'll need to get that order in the state where the person in question lives or is conducting the activity you wish to limit. Even then, if you are living in a different state, the court has no reason to feel that you're in any imminant danger...so....no need for the order. Unless you've got unlimited time and funds to travel and pursue the issue, then your better bet is to learn to take CONTROL of things. Anonymous calls can be blocked. Emails can be deleted without being read. If someone is communicating with you, it's because you're ALLOWING them to reach you. Try the "delete" button on the keyboard for emails from unknown senders or senders you don't want to hear from. Report such emails as spam to your provider and learn to use the features available to you within your phone, your email system, etc.

As far as the slander, what is the nature of the slander? Are you willing to plunk down $10k retainer to an attorney to pursue such a case? Are you prepared to add to that figure if the case gets to trial some time next year? If you win, does the person you'd be suing have the money to pay? If they won't pay willingly, are you willing to spend MORE time and money to track them down, put leins on their property, etc.?
