    My question involves guardianship in the State of: Michigan
    Hi all. I'm asking for some information about moving out in michigan. As I understand it, you can legally move out in Michigan at 17 because you can not be reported as a runaway. I'm 16 right now but plan to move out as soon as I turn 17. I live with my aunt, who has custody of me right now. I want to move to North Carolina to live with my friend. If I have too I will drop out of high school but I would rather graduate, so that brings me to the question of enrolling in school. I was worried that in order to enroll in high school my friend's parent's would have to take custody of me, but I was told by another friend that I could use power of attorney to enroll in school. Is this true? also, how does power of attorney work?

    While the police cannot generally drag you home at 17, there is nothing in the law preventing your parents from doing so. And it might also be possible for anyone who harbors you as a runaway or encourages your being out of your parents' control to be charged for a crime.

    Don't mistake the loophole in your state's law that prevents the police from dragging you home to mean that you can legally run away with impunity. You are a minor child and your parents' responsibility until you are 18.

    As a minor, a POA does no good for you what so ever, it is not even relevant to running away. Your parents have authority over you as a matter of law.

    Or, preventing your aunt from getting involved, whether she has become your legal guardian via the courts or whether you're with her because it is the wish of one or both of your parents. The bottom line being that your legal guardian would have to give that power of attorney, since you are a minor. It's not as simple as running away and some other adult of your choosing taking the place of your legal guardian (and as Carl mentioned above, if they assist you in defying your legal guardian and crossing state lines, they could be in a MAJOR world of legal trouble). Until you are 18, you live where your guardian ALLOWS you to live, or you live outside the law and put those people aiding you at risk of criminal charges of their own.

    (And for God's sake, don't use your name when posting to boards like this. Do you have any idea how many predators are out there, just looking for young girls who are having "problems"...so they can prey on them???? Google and FaceBook are open doors into your life!)

    You can consult the school district in North Carolina where you intend to enroll to determine their policies for enrollment and for proof of local residency.

    Note, North Carolina maintains juvenile court jurisdiction through the age of 18, so you can be treated as a runaway in that state and your case can be handled through the juvenile courts of that state.
